Consulting Engineers Diversified Inc. letter of April 7, 1981. <br />The above were noted with no further comments at this time. <br />D. COMMISSION BUSINESS <br />1) Mr. Dennis Holmquist rezoning from R -1 residential to B -1 <br />Business <br />Mr. Dennis Holmquist is requesting that the property, which <br />is presently zoned residential, be rezoned to B -1 Business. <br />The property is presently being used as a duplex which is a <br />nonconforming use. <br />The following findings of fact were reviewed: <br />1) The applicant has properly applied for rezoning of a parcel of <br />property from R -1 Residential to B -1 Business. <br />2) That the property is legally described as Lot 3 Auditors Subdivsion <br />#96 and is generally known as 6326 Highway #10 N.W. <br />3) That the applicant appeared before the Planning Commission at their <br />regular meeting of April 7, 1981 for a public hearing and presented <br />his request. <br />4) That said public hearing was properly advertised and a copy of said <br />hearing notice is hereby incorporated by reference. <br />• 5) That the applicants property is adjoined on two sides by B -1 Business <br />zoning and by R -1 Residential zoning on the other two sides. <br />6) That the only access to the applicants property is by easement and <br />the subject property does not abut a dedicated public street. <br />7) That there are no proposals to extend any city streets in this area. <br />81 That the applicant has not submitted a site plan showing compliance <br />with city ordinances for structure location, parking, etc. <br />9) That said application is subject to Metropolitan Council reviewal <br />and approval. <br /> I <br />Arthur Dunn stated the proposed zoning change R -1 to B -1 <br />should include as a finding of fact that it would be in <br />conflict with the Critical River Zoning and 1.5 acres is in <br />excess of present allowed density as number 10; and the fact <br />that a 2 family dwelling is presently not a permitted use as <br />number 11. <br />P &Z /April 7, 1981 <br />E <br />
