Motion by Gerald Zimmerman and seconded by Arthur Dunn to recommend <br />to the city council approval of the conditional use agreement <br />and findings of fact including insect and rodent control provisions <br />and grant Mr. Hetland a conditional use permit. <br />Motion carried. .Voting yes: Chairman Kenneth Peterson, Benjamin <br />Deemer, Arthur Dunn and Gerald Zimmerman. Voting no: None. <br />3) Rezoning Request for Mr. Fdward Klemish <br />Mr. Klemish wishes to rezone from R -1 residential to B -1 Business a <br />lot jsut west of Quicksilver Street and north of 167th Avenue N.W. <br />He has indicated he would like to have a beauty shop and office area. <br />Wewould note that some of the soils in the area are quite heavy and <br />a beauty shop, with its water usage, may not be advisable. We <br />would further note that in the last two to three years, requests <br />for rezoning other parcels in the immediate area have been denied. <br />• Chairman Kenneth Peterson read the findings of fact as <br />in the agenda. <br />Discussion: Arthur Dunn says a number 10 finding of fact should <br />include the proposed use would result in more water use than would <br />occur then if the parcel was left in its present zoning. <br />Kenneth Peterson and Benjamin Deemer stated a number 11 <br />finding of fact should include that the applicant has not <br />submitted a site plan showing compliance with city ordinances <br />for structure location, parking, etc. <br />Arthur Dunn adds to findings of fact number 5 . . . on the other <br />side. .separated by a street. <br />• Motion by Benjamin Deemer and seconded by Arthur Dunn to adopt <br />the findings of:fact with additions and recommend disapproval of <br />rezoning based on the findings of fact. <br />Motion carried. Voting yes: Chairman Kenneth Peterson, Benjamin Deemer <br />Arthur Dunn and Gerald Zimmerman. Voting no: None. <br />Benjamin Deemer says for the record his major objection is <br />the necessity of rezoning without having a complete site plan so <br />we know what we are voting and discussing regarding the rezoning. <br />Hetland asks why the commission can't go by the guidelines <br />for commerical zoning. <br />Gerald Zimmerman stated for the record his objection would be <br />soils; the business would be detrimential to the present septic <br />. _system. _ <br />P &Z /April 7, 1981 <br />4 <br />
