Problem Guy's Trucking is operating a truck terminal in a B -1 <br />zone which make their operation a non - conforming use in that <br />B -1 zoning as that type of an operation according to the City <br />Code should be in an Industrial District (I -1). However, they <br />were grandfathered into zoning as a non conforming use when the <br />zoning district was established, but the City should have an <br />agreement with them establishing parameter for their operation. <br />This I have discussed many times with the Council on the grand - <br />fathered non conforming uses. <br />Further, our ordinance does not state what the set back will be <br />in situations such as we have with the Guy's Trucking. As they <br />do not create an sunsage road condition for customers coming <br />out of Jim's place. Now, Jim states that he has talked to Guy's <br />about the parking of their vehicles but it doesn't do much good. <br />We do not have any written agreement with them in regards to how <br />they park their semi - trailers on their own property, so the city <br />is not really in a position to say anything. <br />Council Action: Council action on this may be to call in Guy's <br />Trucking and work up an agreement with him and establish parameters <br />for his operation there. <br />i CASE #9: TAX INCREMENT F INANCING : <br />Enclosure (D3 -g) contains League of Cities memo requesting <br />assistance from its members to save tax increment financing. It <br />seems as though some legislators are bound and determined to do <br />away with this type of Commercial and Industrial development in <br />communities. However, it used to be one of the finest pieces of <br />legislation to develop your community with out of federal or state <br />grant funds. <br />Council Action Your action should be to at least note that this <br />state law is endangered. However, if we are in support of it, we <br />should contact our legislators. <br />
