I have dec~ded, for the following reasons, to <br /> not accept the council's proposal: <br /> <br /> In reference to the City Staff's Recommendation: <br />' (1] I was not the owner of tI%e house at the' t~me it'was ~uilt and, therefore, <br /> should not be held responsihle for negligence on the part of the City or- <br /> the builder. <br /> (2] The need for a culvert was stressed at'the time of the public .hearings <br /> (see the enclosed notes of the minutes of the public hearing of October-9, <br /> 1979). <br /> In reference to the other points laid out by the City Staff, I would <br /> like to resk%ond point by polnt: <br /> (1) This statement is correct . · <br /> (2~ If past City policy required homeowners to put in culverts where <br /> required, why did the City Build~g Inspector allow the builder to put in <br /> an access without a culvert? <br /> (3] & (4} Same response as to (2] above. <br />' (5] & (6] ~rrelevant to the casa. <br /> [7) This statement is true. <br /> [81 see notes of October 9., 19~9, as t~is issue was addressed at that <br /> time fsee attached minutesI. <br /> (9] See the response to <br /> (10] The ditch should have been regraded at the time the access road~was <br /> paved. .. <br /> (11~-Iwould prefer proper d~a~n.age and run-off to the use of the right-of-way <br /> for park~.g purposes.. <br /> <br /> ,/ I wish to emphasize that, as I stated on October ~, 19~R, in other <br />areas where problems were create~ or aggravated <br /> development,'not only were culverts installea, 5ut, al~o, those acceSS <br /> approaches ~ere built up and paved at C~ty expense.' Th~ same procedure <br /> should apply in this case.' <br /> It is therefore my conclusion that I should not,be requested to share in the <br /> cost of th/s installation. If the City'Councfl goes along w~th the <br /> contention of ~ngineer Raati~ka that the water ~11 d~ssipate by seepage and <br /> that there is no need for a culvert (Octoher ~,1~7~ minut~s~, ~y only <br /> alternative w~ll be to build up the'driveway to the proper level and pave <br /> over the approach. <br /> <br />Thank you f0~ your consideration to this manner. <br /> <br />· erel ~, <br /> <br /> <br />
