PROPOSED FINDINGS OF FACT RE: RANDALL LINDGREN CONDITIONAL USE PERMIT 1) That the applicant has properly applied for a conditional use permit as required by City Ordinance to maintain a private kennel. 2) That the applicant appeared before the Planning and Zoning Co~mission for a public hearing pursuant to the City Zoning Ordinance on June 2, 1981. That said public hearing was properly advertized and the minutes of that public heari~ng are hereby incorporated by reference, 3~ That the Standards for Consideration are as follows: a) The property is zoned R-1 and this is not a permitted b ~ The adjoining properties are residential dwellings located on approximately one to five acre parcels. c) The closest similar use is approximately three (3) Eiles, d~ There will be no ch.a~ge in traffic flow to the area. e~ There are three ~3) known kennels in operation in the City which to our knowledge have not caused neighborhood probl~m~, However, there are numerous individmm~l~ that should have conditional use permits for private kennels that do cause probl~m~ because of a lack of proper facili- tiesto control animls. f) Properly maintained, the kennel should not affect the life style of the neighboring residents in a rural setting Further, it should not affect the enjoyment or value of properties in the vicinity.- That the Criteria for Approval/Disapproval are as follows: a)' The applicants request to maintain five C5) ad~_lt hunt- ing dogs, if properly maintained, should not be detrimental to or endanger the public health, safety or general w~lfare and is not contrary to established standards as regulated by City Codes. However, persistent barking would be a nuisa-nee, b) The applicants proposed kennel area has not been viewed by a Doctor of Veterinary Medicine as required of previous conditional use permits of this nature.
