Case <br /> <br />PROPOSED ORDINANCE TO AMEND SECTION 8.35 (REGULATION OF SINGLE <br />FAMILY DWELLINGS TO BE MOVED INTO OR WITHIN THE CITY <br /> By: Chris Anderson, Zoning & Recycling Coordinator <br /> <br />Background: <br /> <br />Moving a dwelling into or within the City requires a Dwelling Moving Permit (DMP). However, <br />there are no standards or permit requirements to move a dwelling out of the City or for moving an <br />accessory building into, within, or out of City limits. Currently, the DMP process requires that <br />the request is presented to the Planning Commission and then ultimately to City Council. The <br />process requires approximately two (2) months from the time an application is received until City <br />Council votes on the matter. Since the regulations for moving a dwelling into or within the City <br />are in Chapter 8 (Building & Housing) of City Code and not Chapter 9 (Zoning & Subdivision of <br />Land), a public hearing is not required when amending this section. However, because a request <br />for a DMP currently is under the Planning Commission's purview, Staffthought it appropriate to <br />present the proposed amendments to the Commission. <br /> <br />The following items are enclosed for your information: <br /> <br />A. Proposed Ordinance to amend Section 8.35 <br /> <br />Observations: <br /> <br />The proposed revisions are aimed at accomplishing several things. First, provisions have been <br />included that would require a Moving Permit to be obtained from the .Building Division if a <br />dwelling were to be moved out of the City or if an accessory building (greater than 120 square <br />feet in size) were to be moved into, within, or out of the City. After conferring with the Building <br />Official, this type of permit will allow the City to verify, prior to a building being raised and <br />relocated, that all utilities have been properly shut off and/or capped and that the foundation is <br />properly removed and/or backfilled. Secondly, the entire DMP process would be streamlined by <br />eliminating the need for the request to be presented to both the Planning Commission and City <br />Council. While City Staff would now have the ability to administratively approve or deny a <br />DM? application, the conditions and criteria currently used to evaluate this type of request would <br />remain in tact. <br /> <br />Recommendation: <br /> <br />City Staff recommends forwarding the proposed ordinance amendment to City Council for <br />adoption. <br /> <br />Commission Action: <br /> <br />Motion to recommend that City Council adopt the proposed ordinance to amend City Code <br />regulations regarding moving dwellings and accessory buildings into, within, or out of the City. <br /> <br />Review Checklist: Copies To: <br />Asst.
