SECTION 4. PROHIBITION <br /> <br />During the term of this Ordinance. notwithstanding Chapter 9 of the City Code, entitled?Zoning <br />and Subdivision of Land", no subdivision or platting of any land shalI be perm/fled and ncr <br />applications for said subdivision or platting shall be accepted for the R-1 Rural Developing Zoning <br />District, as defined by the City's Official Zoning Map, revised February 28. 2006. <br /> <br />SECTION 5. UNDUE HARDSHIP EXCEPTIONS <br /> <br />The City Council may gr~t an exception to the provisions of this Ordinance when. in irs op~mon, <br />undue hardship may result form strict compliance. In granting art exception, the City Council shall <br />prescribe any conditions that it deems necessary to or desfrable for the. protection of the public.. ' <br />interest. NO exception shall be granted unles~ the City Council finds: <br /> <br /> 1. That there are special circumstances or condftions affehting said property such that <br /> the strict application of the provisions of this Interkra Ordinance would deprive the <br /> petitioner of the reasonable use of petitioner's land. <br /> <br /> That the exception is necessary for the preservation and enjoyment of a substantial <br /> property right of the petitioner: <br /> <br /> 3. That the gantin~ Of the exception will hot be--detfirr~ental to the public welfare or <br /> injurious to other property in the area in which the' property is situated. <br /> <br /> 4. That the proposed exception ?vill bb harmoniods with and in accordance with the <br /> specific objectives of the City's existing Comprehensive Plan and will not adversely <br /> <br /> : affect the plarmi~ng process for adoptioa of amendments to the Comprehensive Plan <br /> above described. :i <br /> <br /> , ),2-'' That the propoi~ed use/subdivision will be consistent with the intent and purpose of <br /> thfs'Ordinanc~: '-~. <br /> <br />'SECTION 7.
