Residential Development. Residential uses are permitted in all overlay <br />subdistricts per the requirements of the underlying zoning district. <br /> <br />Business and Industrial Development. Business uses are permitted in all overlay <br />subdistricts as identified in Executive Order 79-19, per the requirements of the <br />underlying zoning district and guidance from the Comprehensive Plan. <br /> <br />Aericultural Uses. All agricultural uses shall be permitted in all overlay districts <br />except new feedlots which shall not be permitted. <br /> <br />Mining and Extraction. No new mining and extraction shall be permitted in any <br />overlay district and existing mining operations shall not be permitted to expand. <br /> <br />Signs. No general advertising signs shall be permitted in any overlay district <br />which are visible from the. Mississippi River or which are prohibited by the <br />provisions of the zoning code. <br /> <br />Public/Private docks. Commercial marinas are prohibited. Individual and shared <br />use docks are regulated by the DNR as regulated by Minnesota Rules on public <br />water bodies. <br /> <br />Subd. 3. Conditional Uses. <br /> <br />Within any of the Mississippi River Overlay Subdistricts no structures or land <br />shall be used except for one or more of the following uses or uses deemed similar <br />by the City Council except by a conditional use permit. <br /> <br />1. Aboveground transmission service lines. <br /> <br />Public marinas, boat fueling facilities, boat accesses or boat launching <br />ramps to the Mississippi River. <br /> <br />3. Dumping of dredge spoils, dredging or construction or pilings. <br /> <br />Impervious surface may not exceed 25% except by CUP, and shall in no <br />case exceed 35%. Not permitted for riparian lots. <br /> <br />Expansion of non-conforming structures, so long as no additional <br />encroachment on river and bluff setbacks is created and additional <br />development standards are met. <br /> <br />Subd. 4. Conditional Use Criteria. <br /> <br />The granting of a Conditional Use Permit shall be in accordance with procedures and <br />criteria established in item C, Purpose and Intent, of this Section and the Zoning <br />Regulations Section 9.03.04. <br /> <br />A conditional use development shall not be permitted if said development is expected <br />to cause erosion or sedimentation, an intrusion into a scenic area, disruption of a <br />wildlife habitat, removal of extensive areas of vegetation or has a potential for a <br />similar adverse effect upon a portion of the Mississippi River Overlay District. <br /> <br />-7- <br /> <br /> <br />
