9.21.05 <br /> <br />General Provisions <br /> <br />Subd. 1. The General Provisions are established to provide a high standard of <br />development and protection of the natural environment in the Mississippi River <br />Overlay District. <br /> <br />Subd. 2. Vegetation Management. Trees and natural vegetation are important <br />elements, both ecologically and aesthetically, within the Mississippi River corridor. <br />Therefore, a greater emphasis shall be placed on preserving existing trees and natural <br />vegetation within this Overlay District, especially within riparian areas. The <br />following standards shall apply to all lands within the Mississippi River Overlay <br />District: <br /> <br />a. On undeveloped islands~ public recreation lands, the slope or face of <br /> bluffs, within 200 feet of the normal high water mark of the river, and <br /> within the area 40 feet landward from bluff-lines, clear-cutting shall not <br /> be permitted. <br /> <br />b. On all other lands within this district, clear-cutting shall not be permitted <br /> unless in conjunction with an approved site development plan. <br /> Furthermore, these lands shall be guided by the following provisions: <br /> <br />Any clear-cutting shall require site development plan approval by <br />the City prior to commencement. The permittee shall submit a <br />plan to the City showing the size, location, and species of all trees <br />on the site and which trees are proposed to be cut. The plan shall <br />be drawn to an accurate scale. The site development plan and any <br />associated permit application(s) shall be reviewed by the Zoning <br />Administrator. <br /> <br />Clear-cutting shall not be used where soil, slope or other water <br />shed conditions are fragile and subject to injury; <br /> <br />Clear-cutting shall be conducted only where clear cut blocks, <br />patches or strips are, in all cases, shaped and blended with the <br />natural terrain; <br /> <br />4. The size of clear-cut blocks, patches or strips shall be kept at the <br /> minimum necessary; and <br /> <br />Where feasible, all clear-cuts shall be conducted between <br />September 15 and May 15. If natural regeneration will not result <br />in adequate vegetation cover, areas in which clear-cutting is <br />conducted shall be replanted to prevent erosion and to maintain the <br />aesthetic quality of the area; and where feasible, replanting shall be <br />performed in the same spring or the following spring. <br /> <br />-8- <br /> <br /> <br />
