The City Council has adopted s long-range plan providing for tho <br />periodic reconstruction, including mill and overlay, of si1 paved city s~ee~. With th~ <br />impmv~mant of s~o~, a a mmlt of mconstmc~on or mill and overlay, adjoi~n~ pmp~gies <br />receive special benefit ~a% ms~a. in th~ incr~s~ of ~ proper~'s valan. It is thc policy of <br />th~ City that ~is special ben,fit should be paid for by tho prop~r~y owner ~ceivin~ ~ sp~clal <br />bone. fit r~er ~a the CiW as a wlmle. This is accomplished by specially ass~sing tho <br />benefited property as suborned by State Stature, See~on 429. q~o foilowlng is ~o ~ty of <br />Plymou~'s policy regm~ng special assessments to properties benefiting ~'om s~eet <br />improvements~ <br /> <br />a, It is the policy of tho City 'to special assess abutting benefitk'~g property for <br /> street reconstruction costs, but not in excess of tho.. special benefit to tho <br /> property. This policy applies to all streets that are I/ublic streets. <br /> <br />b. ThoassessinentmnountforthcreconstnmtionormillandoveHayofprevlously <br /> paved streets shall be determined annuuily by the City Council. <br /> <br />The assessment amount is based on the following: <br /> <br /> In 2006 benefited properties shall be assessed 35% of the engineer's <br /> estimated project co~ as set forth ia the project feasibility report or <br /> 35% o£ tho actual project cost, whlchovcr amouat is loss. In 2007 and <br /> thereafter, the rate shall be 40%. <br />(2) For th~ purposes of street reconstruction or mill md over'icy, the project <br /> costs will include tho cost of replaolng or r*pslring ce~crete curb and <br /> gutter, In those cases whore bituminous curbing is replaced with <br /> concrete curb end g~.~ttor, or Where curb and gutter did not previously <br /> exist, the additional special benefit will bo assessed.. Tho cost to be <br /> assessed shall be 100% of the cost of imtalling the ~oncrete curb and <br /> gutter. This cost will bo assessed on either a front foot or per lol;'basis. <br /> The addition of a storm sewer system will also bo considered an <br /> additional benefit and shall be assessed at t 00% of tho cost. <br /> <br />(3) Pmj ~ct cost includes both direct construction costs and all lndireo~ costs <br /> such as engineering and administration. <br /> <br />(4) <br /> <br />Assessments shall ~ormally b~ levied for a period not to exceed five (5) <br />ye~s for assessments of $5,000 or less, ten (10) yeats for assessments <br />greater than. $5,000 but $10,000 or tess, and Fifteen (15) yem's for <br />assessments greater than $10,000. <br /> <br />-291- <br /> <br /> <br />
