The proposal submittal shall include ten (10) bound duplicate copies. Any other <br />materials, as indicated in 7.1, shall be submitted as a single original in a separate <br />envelope. <br /> <br />2. All original volumes should be subdivided and tabbed as follows: <br /> <br />Section 1 ........ Development Team <br />Section 2 ........ Statement of Financial Capability <br />Section 3 ........ Development Proposal and Design <br />Section 4 ........ Preliminary Plan of Finance & Business Offer <br />Section 5 ........ Implementation Schedule <br />Appendix .......Any voluntary attachments or drawings to supplement Section 1 & 2 <br /> <br />9. Other Information <br /> <br />9.1 Confidential Information <br />The confidentiality of each Proposal shall be maintained by the City, subject te those restrictions <br />on confidentiality imposed upon the City by the State of Mirmesota's Government Data Practices <br />law, codified in Chapter 12 of Minnesota Statutes. <br /> <br />9.2 Ownership and Use of Proposal <br /> <br />The City shall be entitled to retain and use without compensation to -any person any information <br />submitted, including but not limited to any concept, element or idea (including financial or <br />ownership structures or schemes) disclosed in or evident from the Proposal. All information <br />submitted in a response to this RFP shall become the property of the City. <br /> <br />9.3 Amendments to and Cancellation of Procurement Process and/or Project <br /> <br />The City reserves the right at its sole and absolute discretion and without liability to modify, <br />amend or otherwise change, or to extend, suspend, postpone or cancel, any part of this RFP, the <br />Proposal arid any part of or all of the Project implementation process. <br /> <br />9.4 No Liability <br /> <br />The City and its respective officers, employees, consultants and agents, shall not under any <br />circumstances, including pursuant to contract, tort, statutory duty, law, equity or otherwise, or <br />any actual or implied duty of fairness, be responsible or liable for any costs, expenses, loss of <br />opportunities, claims, losses, damages or any other liabilities to anyone, including any Developer <br />or Development Team Member, arising out of or related to the RFP, attendance at any <br />information meeting, or the preparation, acceptance or rejection of any RFP, or the amendment, <br />cancellation, suspension or termination of the RFP, or the Project.
