1 2. Not be readily visible. <br />2 b. Directional signs for patrons arriving at a business by watercraft must comply with the <br />3 following standards: <br />4 1. They must be consistent with Minn. Stats. § 866.115. <br />5 2. Only convey the location and name of the establishment and the general types of <br />6 goods and services available, if located in a shore impact zone. <br />7 3. Be no greater than ten feet in height and 32 square feet in surface area; and <br />8 4. If illuminated, the lighting must be shielded to prevent illumination out across the <br />9 river or to the sky. <br />10 (7) Fences. Fences between principal structures and the river are allowed provided that fences <br />11 are: <br />12 a. Not higher than six feet. <br />13 b. Not located within 40 feet of slopes greater than 12%. <br />14 c. Not located in the regulatory floodplain. <br />15 (H) Performance standards for public facilities. <br />16 (1) Purpose. To establish design standards for public facilities that are consistent with best <br />17 management practices and that minimize impacts to primary conservation areas, public river <br />18 corridor views and other resources identified in the MRCCA plan. Public facilities serve the <br />19 public interest by providing public access to the Mississippi River corridor or require locations <br />20 in or adjacent to the river corridor and therefore require some degree of flexibility. <br />21 (2) General design standards. In addition to the standards set forth above, all public facilities <br />22 must be designed and constructed to: <br />23 a. Minimize visibility of the facility from the river to the extent consistent with the purpose <br />24 of the facility; <br />25 b. Gomply with the structure placement and height standards in section 117 148(f) <br />26 structure height and placement and4ot size), except as provided in section 117 148(1) <br />27 (exemptions); <br />28 •c. Be---eonsistent with the vegetation management standards in Scction 117 148(i) <br />29 (vegetation management) and the land alteration and storm water management <br />30 standards in section 117 148(j) (land alteration standards and stormwatcr <br />31 management), including use-ef practices identified in Best Practices for Meeting DNR <br />32 General Public Waters Work Permit GP 2004 0001, where applicable; <br />33 d. Avoid primary conservation areas, unless no alternative exists. If no alternative exists, <br />34 then disturbance to primary conservation areas must be avoided to the greatest extent <br />35 practicable, and design and construction must minimize impacts; and <br />36 e. Minimize disturbance of spawning and nesting times by scheduling construction at <br />37 times when local fish and wildlife are not spawning or nesting. <br />38 (3) Right-of-way maintenance standards. Right-of-way maintenance must comply with the <br />39 following standards: <br />40 a. Vegetation currently in a natural state must be maintained to the extent feasible; <br />41 b. Where vegetation in a natural state has been removed, native plants must be planted <br />42 and maintained on the right-of-way; and <br />43 c. Chemical control of vegetation must be avoided when practicable, but when chemical <br />44 control is necessary, chemicals used must be in accordance with the regulations and <br />45 other requirements of all state and federal agencies with authority over the chemical's <br />46 use. <br />47 (4) Crossings of public water or public land. Crossings of public waters or land controlled by the <br />48 commissioner are subject to approval by the commissioner according to Minn. Stats. §§ <br />49 84.415 and 103G.245. <br />Page 109 of 160 <br />
