1 (2) Landings or takeoffs of an aircraft of a governmental agency operating in its official capacity; <br />2 or <br />3 (3) Landings or takeoffs which the city is pre-empted from regulating. <br />4 (C) Heliport permits. <br />5 (1) The interim use permit for a personal use heliport may be issued if the city council makes the <br />6 following findings: <br />7 a. Noisc Icvcls comply -with Minn. Rulcs ch. 7030. <br />8 b. That the aircraft operator is licensed to the extent required by FAA. <br />9 c. The use heliport is licensed by Mn/DOT office of aeronautics. <br />10 d. In the event the applicant for the permit does not own the property on which the <br />11 heliport is proposed to be sited, the applicant must provide the city with evidence of <br />12 written permission from the property owner to land or takeoff4or lands owncd by thc <br />13 city, thc written p•crmission of the city council shall be rcquircd. <br />14 e. That persons or property will not be unduly endangered as a result of the landings or <br />15 takeoffs. Among the factors to be considered are the location and size of the proposed <br />16 landing/takeoff site, surrounding land uses and structures (such as buildings, power <br />17 poles, signs, or fences), existing terrain and foliage, numbers of persons expected to be <br />18 at or about the site, and flight paths to or from the site. <br />19 (2) If granted, the terms of the permit shall include but not be limited to the following items: <br />20 <br />Requirement Zoning Districts <br />Residential Business Industrial <br />Minimum lot size 3 acres None None <br />Minimum altitude over structures and 500 500 500 <br />people <br />Permitted takeoff/landing hours 8:00 a.m. — 7:00 a.m. — 24 hours a day <br />sunset sunset <br />Frequency restriction on landings and 24/6 hours 24/4 hours None <br />takeoffs <br />21 <br />22 (3) Liability insurance and liability indemnification. The permit holder shall secure and maintain <br />23 insurance from an insurance company acceptable to the city and authorized to write casualty <br />24 insurance in the State of Minnesota which will protect the permit holder, its agents and <br />25 employees and the city from claims for bodily injury, death or property damage which may <br />26 arise from the operations on the subject property. The permit holder shall file a certificate of <br />27 insurance or a certified copy of the insurance policy with the city. Such insurance policy shall <br />28 contain a clause providing that it shall not be cancelled by the insurance company without 30 <br />29 days' written notice to the city of intention to cancel. The following coverage shall be provided <br />30 in amounts not less than those specified for public liability, general liability, personal injury <br />31 and property damage: <br />32 a. Injury or death of one person: $1,000,000.00. <br />33 b. Injury to more than one person in a single accident: $1,000,000.00. <br />34 c. Property damage: $1,000,000.00. <br />35 d. Total aggregate liability for all items: $1,000,000.00. <br />36 (4) The heliport will have adequate marking and signage to alert users of the property as to the <br />37 location of the heliport and to delineate a safe distance from the heliport during helicopter <br />38 operations. <br />Page 43 of 160 <br />
