Councihuember Olson concnn'ed. She stated regardless of which access is closed, staff should be directed to begin negotiations with Mr. Thompson to create totally new access. Councilmember Cook asked if the original Shade Tree motion made on June 14th would be reverted to if any of the contingencies of this motion do not happen. City Administrator Norman replied that is staff's opinion of this action. Couneilmember Elvig stated he does not want this motion to die because a difference of opinion on the north or south access from CR 5. He indicated the City should negotiate with Mr. Thompson regarding the access. Com~cilrnember Cook noted closing one of the accesses on old CR 5 would allow some negotiation with Mr. Thompson. The motion on the floor was amended as follows: that the following motion adopted by the Council on June 14, 2005, to-wit: That thc following street alignment be incorporated for the preliminary plat and site plan approval of Shade Tree Cottages: Keep the general alignmcnt of Potassinm Street ~vith the street moved as much as possible to the west, to improve Potassimn Street to a nlininlum standard width with a nlinimum impact. Bc RESCINDED and replaced with following motion to-wit: Motion to instruct City Staff to nndertake the following tasks in order to address transpm'tation needs iu the area of Nowthen Boulevard (CSAI:I), Old Nowthen, Potassium Street and Alpine Drive. a. Keep the new Potassium Street road aligmnent as far west as possible and construct it to 24' (curb to curb) in width, with the west skle curb to be concrete and the east side to be bituminous curb. b. Require the establislunent of a temporary public road access fl'om Qnicksilver Circle to CSAH 5 through the Shado Tree Cottages developmm~t conditioned on the affected property owners on Potassium Street agreeing in writing to convey the necessary easement for the new Potassium Street road aligmnent to the City by September 1, 2005. c. Stal'f is directed to negotiate first rights of refusaI xvith the propm'ty owners of the four properties located on the NE corner of Connty #5 and Alpine Road for pmt)oses of acquMng roadway easements for a routing fi'om Potassimu to Alpine with the purpose being the eventual closure of all accesses on County #5 fi'om 157th to Alpine Road, including the closure of the temporary public road access from Quicksilver Circle to CSAH 5 described in (b) above. d. Close and cul-de-sac one of the accesses to CSAI-I 5 from Nowthen Boulevard. Motion cm~'ied. Voting Yes: Mayor Gamec, Councihnembers Elvig, Jeffrey, Cook, Olson, Pearson, and Strommen.
