#7: That the Applicant is proposing to erect a sign for the new Burger King facility on the <br />Subject Property that will exceed the area and height restrictions established by City Ordinance. <br />City Staff has recognized that an exception to the size requirement maybe appropriate. <br /> <br />#9: That a conditional use permit to exceed sign size restrictions by 45 feet will not grant the <br />Applicant special privileges that are denied by the City Code to other properties in the <br />commercial area. <br /> <br />#10: That a conditional use permit to exceed sign height restrictions consistent with adjacent <br />properties will not grant the Applicant special privileges that are denied by the City Code to <br />other properties in the commercial area. <br /> <br />#11: That the proposed increase in sign surface will be designed so as to be harmonious and <br />appropriate in appearance with the existing or intended character of the vicinity and will not <br />change the essential character of the area. <br /> <br />#12: That the proposed increase in sign height, to the extent deemed necessary to conform with <br />adjacent signage, will be designed so as to be harmonious and appropriate in appearance with the <br />intended character of the vicinity and will not change the essential character of the area. <br /> <br />#13 - 24: Should all read "will not". <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Johnson, Dempsey, <br />Jensen, Kociscak, Nixt, and Wivoda. Voting No: None. <br /> <br />Motion by Commissioner Jensen, seconded by Commissioner Johnson, to recommend that City <br />Council approve the issuance of a conditional use permit based on the findings of facts in the <br />affirmative, and adopt a resolution declaring terms of a conditional use permit. <br /> <br />Further discussion: Commissioner Johnson suggested changing the wording of #1 in the <br />resolution to read "The Permittee is herein granted permission to erect a freestanding pylon sign <br />with a businesses identification sign surface area not to exceed a 100 square feet and a reader <br />board, not to exceed 45 square feet, at a height consistent with adjacent signage." <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Jensen, Johnson, <br />Dempsey, Kociscak, Nixt, and Wivoda.
