Chairperson Anderson noted the staff review letter recommends installation of an elongated pond <br />and questioned if the drainage plan has been modified accordingly. <br /> <br />Dennis Peck stated that the grading and drainage plan has been approved by the City Engineer as <br />proposed. <br /> <br />Motion by Commissioner Dempsey, seconded by Commissioner Kociscak, to recommend that <br />City Council grant preliminary plat approval to Northfork Itasca Point contingent upon <br />compliance with City Staff Review Letter dated March 31, 1999, with the exception of <br />recommendations for modifying the grading plan. <br /> <br />Motion Carried. Voting Yes: Chairperson Anderson, Commissioners Dempsey, Kociscak, <br />Johnson, and, Nixt. Voting No: None. Absent: Commissioner Jensen and Wivoda. <br /> <br />Case #4: Request for a Minor Subdivision; Case of Ron Danner <br /> <br />Zoning Administrator Frolik stated that Ron Danner is requesting sketch plan approval of a <br />minor subdivision to plat his 27 acre parcel into one lot and one outlot. <br /> <br />Zoning Administrator Frolik explained that Mr. Danner's intentions are to plat the homestead <br />onto a smaller parcel and sell it. The property is in the Rum River Scenic Overlay District and <br />the homestead is adjacent to the River. The minimum lot size for riparian lots in the Scenic <br />River District is 4 acres. Lot 1 is proposed to be 4 acres in size and the remaining 23 acres will <br />be platted as outlot for possible future development. This one lot plat will also be in compliance <br />with the 4 units in 40 acres density restrictions. <br /> <br />Zoning Administrator Frolik explained that the homestead currently has and will continue to <br />have access to Erkium Street to the north via a private easement. The sketch plan shows how Lot <br />1 can be served by a public road at some point in the future in approximately the same location <br />as the current private easement. Any future resubdivision of the Outlot will require construction <br />of a public road into the property. <br /> <br />Zoning Administrator Frolik explained that City Cody requires submittal of a resubdivision plan <br />to urban densities. The subject property is not anticipated to be included in the Metropolitan <br />Urban Service Area within the next 20 years, so staff has requested a resubdivision plan that <br />would comply with the Scenic River Regulations if the 4 units in 40 acres density restriction is <br />abolished. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Kociscak, to accept the sketch <br />plan for the Ronald Danner minor subdivision contingent upon compliance with City Staff <br />Review Letter dated April 28, 1999 and advise the applicant to proceed to the final plat stage. <br /> <br />Further discussion: Commissioner Dempsey questioned item #7 from the City letter to Mr. <br />Danner regarding the private easement which would still be included on the property.
