<br />  CITY CODE WHICH IS KNOWN AS THE
<br />  MUNICIPAL REGULATIONS CHAPTER
<br /> AN ORDINANCE AMENDING SECTION
<br /> L5,09.03 OF CHAPTER 5 OF THE CITY CODE
<br />      REGULATING DOGS
<br />     T. he City of Ramsey hereby, ordains as
<br /> follows:
<br /> SECTION 1, AUTHORITY
<br />     This ordinance is adopted pursuant to and
<br /> under the authority of. the Charter of the City
<br /> of Ramsey.
<br /> SECTION 2. AMENDMENT
<br />     Section 5.09.03, entitled "Dog Regula-
<br /> tions'' shall be amended as follows:
<br /> Under Subdivision 1 "Definitions." add the
<br />  following:                          ' '
<br />  Boarding - shall mean providing for the
<br />  care, shelter, or feeding of dog(s), not owned
<br />  by the owner or occupant of the premises
<br />  where said dog(s) are kept, for any period
<br />  ex'ceeding 12 contiggous hours.
<br />  Kennel, Commercial - is a place where
<br />  boarding· and/of training is offered to any
<br />  number of dogs not owned by the owner or
<br />  occupant of the premises. Such boarding
<br />  and/or training may also ind0de but is not
<br />  limited to related uses such as selling, breed,
<br />  lng, showing, treating or grooming· Pet shops,
<br />  veterinary clinics, and pet grooming facilities
<br />  are considered commercial uses but shall not
<br />  be defined as commercial kennels. A Condi-
<br />  tional use permit is required in any district
<br />  where commercial dog kennels are not specifi-
<br />  cally identified as a permitted use.
<br />  Kennel, Private - is a place where a dog
<br />  ~er keeps three (3) or more dogs over six (6)
<br />                      on property occupied by the dog
<br />            for residential purposes and where the
<br />  keeping of such dogs is incidental to the 0ccu-
<br />  pancy of the premises, and may include breed-
<br />  lng and se!ling of dogs as a hobby. An
<br />  Administrative Ke.nnel License is required for
<br />  three (3) dogs and a Conditional Use Permit is
<br />  required for four (4) or more dogs.
<br />  Under Subdivision 1. amend "DOg" to read
<br />  as follows:
<br />  Dog - shall mean any male or female of
<br />  the·canine species. ·
<br />  Uqder Subdivision 1, amend "Owner" to
<br />  read as follows:
<br />  Dog Owner - shall mean the license holder
<br />  or any other person or persons, firm, association,
<br />  or corporation owning, keeping or harboring a
<br />  dog. Any person keeping or harboring a dog for
<br />  five consecutive days shall, for the purposes of
<br />  this Section, be deemed an owner.
<br />  Jn~ert the following and renumber all subse-
<br />  quent subdivisions,accordingly: "

<br />~.mend Subd. 3 "Licensing" to read as follo~5:
<br />    Subd. 3. Licensing. All dogs kept, har-
<br />bored, or maintained in the City shall be:
<br />licensed and registered. Applications for lic.
<br />ense shall be made to the Administrator upon
<br />forms provided by the Administrator. Said
<br />application shall require the owner, among
<br />other information required by the Admin-
<br />    istrator, to supply the name, age, predominant
<br />-breed, sex, color and markings of each dog
<br /> mght to be licensed. In addition, when the
<br /> pplicant or owner has been convicted of via.
<br /> lotion of Subd. 16 relative to the dog sought to
<br /> be licensed, the application shall require proo~
<br /> of public liability insurance in the minimum
<br /> amount of $300,000.00. Upon submission of
<br /> the application and a certificate evidencing
<br /> compliance with the terms and provisions o1'
<br /> Subd. 5., relating to vaccination for rabies; and
<br /> upon payment of a fee as established by City
<br /> Council r~solution, the Administrator or his at
<br /> her designee shall issue a license. Said license
<br /> shall expire two (2) years from the date of the
<br /> most recent rabies vaccination.
<br /> Amend Subd. 4 "Tags" to read as follows:
<br />     Subd. 4. Tags. The license shall be in the
<br /> form of an identification tag and shall be
<br /> affixed by the owner to a collar to be worn by
<br /> the dog. In case a tag is lost or destroyed, a
<br /> duplicate wil[ be issued by the Administrator
<br /> upon presentation of a receipt showing pay-
<br /> ment of the license fee for the current period
<br /> and a payment as established by City Council
<br /> resolution. Dog tags shall no( be transferable
<br /> from one dog to another and no refunds shall
<br /> be made on any dog license fee because o~
<br /> death of the dog or the owners leaving the
<br /> City prior to expiration of the license period.
<br /> SECTION 3. SUMMARY
<br />     The following is the official summary o{
<br /> Ordinance #99-16, which has been approved
<br /> by the City Council of the City of Ramsey as
<br /> clearly informing the public of the intent and
<br /> effect of the ordinance.
<br />     Section 5.Q9.03 (Dog Regulations) shall be
<br /> amended to provide the opportunity for
<br /> administrative kennel licenses .to keep three
<br /> (3) dogs on a property, and amend or add
<br /> '~efinitions for commercial dog kennel, private
<br />     ag kennel, boarding, dog, and dog owner.
<br /> SECTION 4. EFFECTIVE DATE
<br />     The effective date of this Ordinance is thirty
<br /> (30) days after its passage and publication,
<br />

<br />   'fenced runs) are located at least 10 feet
<br />   from any abutting property line. Fenced
<br />     shall not be considered fenced runs.

<br />allowing dogs to run at large or other nuisance
<br />complaints. Kennel licenses expire two (2)
<br />~ye~ars from the date of auth/prization. Biennial
<br />~enewal applications are dkl~, thirty (30) days
<br />before the expiration date.
<br />     A Conditional Use Permit is required for
<br /> four (4) or more dogs.
<br />
