<br />AN AMENDMENT TO CHAPTER 7 OF
<br />THE CITY CODE, WHICH IS KNOWN AS
<br />THE LICENSING AND PERMITS CHAPTER
<br />OF THE CITY CODE
<br />AN ORDINANCE ADDING SECTION
<br />7.86 TO THE CITY CODE WHICH SEC-
<br />TION IS ENTITLED "SALE OF FIRE-
<br />WORKS"
<br />The City of Ramsey Ordains:
<br />SECTION 1. AUTHORITY
<br />This Section is adopted pursuant to
<br />the authority granted by Minn. Stat.
<br />§624.20.
<br />SECTION 2. AMENDMENT
<br />Chapter 7 of the Ramsey City Code is
<br />amended by adding Section 7.86 to pro-
<br />vide as follows:
<br />7.86 Fireworks
<br />Subdivision 1. Sale of Fireworks. It is
<br />unlawful to sell fireworks in the City of
<br />Ramsey, in violation of Minn. Stat.
<br />§ §624.20 through 624.25, inclusive,
<br />which statutes are hereby adopted by ref-
<br />erence. "Legal fireworks" as defined in
<br />this Section may, however, be sold upon
<br />issuance of a license issued by the City.
<br />Subd. 2 Definition. For the purposes
<br />of this Section "Legal Fireworks" is
<br />defined to mean:
<br />Wire or wood sparklers of not
<br />more than 100 grams of mixture
<br />per item, other sparkling items
<br />which are non - explosive and
<br />non- aerial and contain 75 grams
<br />or less of chemical mixture per"
<br />tube or a total of 200 grams or
<br />less for multiple tubes, snakes and
<br />glow worms, smoke devices, or
<br />trick noisemakers which include
<br />paper streamers, patty poppers,
<br />string poppers, snappers, and
<br />drop pops, each consisting of not
<br />more than twenty five hun-
<br />dredths grains of explosive mix-
<br />ture.
<br />Subd. 3 Application. The application
<br />for a license shall contain the following
<br />information: name, address, and tele-
<br />phone number of applicant; the address
<br />of the location where Legal Fireworks will
<br />be sold; the type of Legal Fireworks to be
<br />sold, and the estimated quantity of Legal
<br />Fireworks that will be stored on the
<br />licensed premises.
<br />Subd. 4 Processing Application. The
<br />application must be filed with the City
<br />Clerk together with the permit fee.
<br />Following an inspection of the premises
<br />proposed to be licensed, the City
<br />Administrator shall issue the permit if the
<br />conditions for license approval are satis-
<br />fied and the location of the premises is
<br />properly zoned. If the City Administrator
<br />denies the permit application, the permit
<br />applicant may, within ten (10) days of the
<br />date of denial, appeal the City
<br />Administrator's decision to the City
<br />Council.
<br />Subd. 5 Conditions for License
<br />Issuance. The license shall be issued sub -
<br />ject to the following conditions:
<br />a. The license is non - transferable,
<br />either to a different person or location.
<br />b. The license must be publicly dis-
<br />played on the licensesd premises.
<br />c. The licensed premises are subject
<br />to inspection by City employees includ-
<br />ing police officers during normal business
<br />hours.
<br />d. The sale and display of Legal
<br />Fireworks must be a permitted use in the
<br />zoning district in which the sales are to
<br />.occur. All sales must be conducted from a
<br />permanent enclosed structure.
<br />e. The total inventory of Legal
<br />Fireworks stored on the premises may not
<br />exceed 200 lbs. gross weight if the build-
<br />ing is equipped with an automatic sprin-
<br />kler system. If no system is present a max-
<br />imum of 50 lbs. can be on site.
<br />f. The premises must be in compli-
<br />ance with the State Building Code and
<br />State Fire Code.
<br />Subd. 6. License Period and License
<br />Fee. Licenses shall be issued for a calendar

<br />hereby acknowledged as being the size and kind of type used in the composition and
<br />publication of the notice:
