Development is improper and therefore <br />prohibited which may result in loss and damage to <br />public and private improvements through inundation by <br />flood waters and subsequent expensive construction of <br />storm sewers and other public projects, in the per- <br />manent destruction of natural resources, loss of <br />water retention facilities, open space and wildlife <br />habitats and impairment of public and private water <br />supplies. Minimum area requirements for building <br />sites shall be determined in accordance with the <br />City's Soils Ordinance Chapter 170.04, the standards <br />of the Shoreland Overlay District and the Critical <br />Rivers Area Overlay District. <br /> <br />2) A minimum amount of filling may be allowed when <br />necessary, but in no case shall the following re- <br />strictions on total amount of filling be exceeded. <br />Since the total amount of filling which can be per- <br />mitted is limited, the City, when considering permit <br />applications, shall consider the equal apportionment <br />of fill opportunity to riparian land owners. <br /> <br />Total filling shall not cause the total natural flood <br />storage capacity of the wetland to fall below the pro- <br />jected volume of runoff from the entire area weland <br />water shed generated by a ten year storm. <br /> <br />Total filling shall not cause the total natural nu- <br />trient stripping capacity of the wetland to fall below <br />the nutrient production of the wetland water shed for <br />its projected development. <br /> <br />Only fill, free of chemical pollutants and organic <br />wastes, may be used. Wetlands shall not be used for <br />solid waste disposal. <br /> <br />Grading and filling in overlay district areas or any <br />aleration of the natural topography where the slope <br />of the land is toward a protected water or a water- <br />course leading to a protected water must be authorized <br />by a permit. The permit may be granted subject to the <br />conditions that: <br /> <br />a) The ~mallest amount of bare ground is exposed <br />for as short a time as feasible. <br /> <br />b) Temporary ground cover, such as mulch, is used <br />and permanent ground cover, such as sod, is estab- <br />lished. <br /> <br />c) Methods to prevent erosion and trap sediment <br />are ~mployed. <br /> Ordinance #85-2 <br /> <br />Page 16 iof 37 <br /> <br /> <br />
