170.0711.21 SUBS T~NDARD LO~ <br /> <br />LOts of record which do not meet the dimensional requirements of <br />this ordinance shall be allowed as building sites provided <br />such use is a permitted use; and <br />In a group of two or more contiguous lots under single ownership <br />when any individual lot does not meet the requirements of the <br />ordinance, such lot cannot be a separate parcel for sale or <br />development purposes, but must be combined with adjacent lots <br />under the same ownership so that the combination of lots will <br />equal one or more lots each meeting the requirements of the local <br />ordinance. <br /> <br />170.0711 . 22 NONCONFORMING USES <br /> <br />Nonconforming uses (those uses which are prohibited by this <br />ordinance but which are in existence prior to this ordinance) <br />shall not be intensified, enlarged, or expanded. <br />Nonconforming sanitary systems (those systems which are incon- <br />sistent with the performance standards of the City and Minnesota <br />Pollution Control Agency) shall be brought into conformity <br />or discontinued within five (5) years of enactment of this <br />ordinance. <br /> <br />170.0711.23 SUBS ]I~NDARD USES <br /> <br /> Ail uses in existence prior to the enactment of this ordinance which meet <br />the allowable use criteria of this ordinance but do not meet the minimum <br />dimensional requirements shall be substandard uses. <br /> <br />1. Any structural alteration or addition to a substandard use shall <br /> not be allowed. <br />2. Substandard signs shall be gradually eliminated over a period of <br /> time. <br /> <br />170.0711.3 VARIANCES <br /> <br />Variances require the presence of the following conditions: <br /> <br />1. Strict enforcement of land use controls will result in <br /> unnecessary hardship. <br />2. A variance would not be contrary to the intent and purpose <br /> of the zoning provisions of this ordinance. <br />3. ~here are exceptional circumstances unique to the subject <br /> property. <br />4. A variance will not allow any use which is neither a <br /> permitted or conditional use. <br />5. A variance will not alter the essential character of the <br /> locality as established by the Management Plan for the Rum <br /> River. <br /> <br /> <br />
