Proper care and maintenance of each horse shall be the responsibility <br />of the person, firm or corporation designated as the owner, caretaker, <br />or custodian of such horse. <br /> <br />C. No person shall keep any horse in a manner creating a public or <br /> private nuisance. <br /> <br />SECTION 5. CONTROL,--TRESPASS AND PUBLIC ROAD~VAYS <br /> <br />No person, firm or corporation shall permit any horse of which he is <br />the owner, caretaker or custodian to run at large within the Township. <br />Such animal will be deemed to run at large when it is o[[ the premises <br />owned or rented by its owner and unaccompanied by the owner, or an <br />agent or employee of the owner. <br /> <br />Be <br /> <br />The Town constable or any designated agent of the Township may impound <br />any such animal found at large, and shall provide proper sustenance for <br />any and all such animals impounded. The constable or his designated <br />agent shall within twenty four (24) hours after any such animal has been <br />impounded, post written notice at the town hall describing such animal <br />and stating that it has been impounded. <br /> <br />No legally impounded animal shall be released except to the person <br />displaying a receipt from the Town Clerk showing payment in full of <br />the costs of impounding and care of the animal. If any person, <br />without authority of law, and without first paying the costs due, <br />shall take any impounded animal out of the enclosure in which he is <br />,impounded, he shall be guilty of a misdemeanor. <br /> <br />Schedule of Fees - The following schedule shall be used in determining <br />the total costs due on any animal determined to be at large within the <br />Towns hip: <br /> <br />Fines for animal at large <br /> <br />1st offense <br />2nd offense <br /> <br />3rd offense <br /> <br />Care of impounded animal <br />Trace and catch animal at large <br />Trailer charge <br /> <br /> $5.00 <br />$25.00 <br /> <br />$50.00 <br /> <br />(if it occurs within one year <br />of the first offense) <br />(if it occurs within one year <br />of the first offense) <br /> <br />$ 5.00/day (minimum) <br />$10.00/hour (minimum) <br />Rental cost plus .25 per mile for <br /> total distance involved. <br /> <br />If any horse impounded is not redeemed within fourteen (14) days, the <br />Town constable or his designated agent shall give an additional three (3) <br /> <br /> <br />
