1 880 Architectural Standards <br /> 2 Due to the specialized nature of each of the uses and buildings, no architectural standards shall exist. All <br /> 3 proposed structures shall consider surrounding property uses in a respectful and intentional manner. <br /> 4 Building design shall not be of lesser quality of design as set forth in other sections of this chapter and <br /> 5 surrounding properties. <br /> 6 <br /> 7 881-899 Reserved. <br /> 8 <br /> 9 900 Overlay Districts <br /> 10 In addition to the various zoning districts described in this chapter,an overlay zoning district may be applied <br /> 11 based on the unique characteristics of an area or as required by state- and federally-designated areas. The <br /> 12 underlying zoning district may have further regulations based on the overlay district and the more restrictive <br /> 13 regulation prevails. The following overlay districts (MRCCA, GF, FW, FF, SMO, SRP, TO, H 1 OS, and <br /> 14 WPO) are hereby established according their purpose and the intent of the Comprehensive Plan. <br /> 15 Collectively, these districts are herein this chapter called"overlay districts." <br /> 16 <br /> 17 901-919 Reserved. <br /> 18 <br /> 19 910 Mississippi River Corridor Critical Area <br /> 20 (A) Authority, intent and purpose. <br /> 21 (1) Statutory authorization. This Mississippi River Corridor Critical Area (MRCCA) section is <br /> 22 adopted pursuant to the authorization and policies contained in Minn. Stats., ch. 116G, <br /> 23 Minnesota Rules, parts 6106.0010 6106.0180, and the planning and zoning enabling <br /> 24 legislation in Minn. Stats. chs. 462 and 473. <br /> 25 (2) Policy. The Legislature of Minnesota has delegated responsibility to local governments of the <br /> 26 state to regulate the subdivision, use and development of designated critical areas and thus <br /> 27 preserve and enhance the quality of important historic, cultural, aesthetic values, and natural <br /> 28 systems and provide for the wise use of these areas. <br /> 29 (B) General provisions and definitions. <br /> 30 (1) Jurisdiction. The provisions of this section apply to land within the river corridor boundary as <br /> 31 described in the State Register, volume 43,pages 508 to 519 and shown on the zoning map. <br /> 32 (2) Enforcement. The City of Ramsey is responsible for the administration and enforcement of this <br /> 33 section. Any violation of its provisions or failure to comply with any of its requirements <br /> 34 including violations of conditions and safeguards established in connection with grants of <br /> 35 variances or conditional uses constitutes a misdemeanor and is punishable as defined by law. <br /> 36 Violations of this section can occur regardless of whether or not a permit is required for a <br /> 37 regulated activity listed elsewhere in this Chapter. <br /> 38 (3) Severability. If any section, clause, provision, or portion of this section is adjudged <br /> 39 unconstitutional or invalid by a court of competent jurisdiction, the remainder of this section <br /> 40 shall not be affected thereby. <br /> 41 (4) Abrogation and greater restrictions. It is not intended by this section to repeal, abrogate, or <br /> 42 impair any existing easements, covenants, or deed restrictions. However, where this section <br /> 43 imposes greater restrictions, the provisions of this section shall prevail. All other sections <br /> 44 inconsistent with this section are hereby repealed to the extent of the inconsistency only. <br /> 45 (5) Underlying zoning. Uses and standards of underlying zoning districts apply except where <br /> 46 standards of this overlay district are more restrictive. <br /> 47 (C) Administration. <br /> 48 (1) Purpose. The purpose of this section is to identify administrative provisions to ensure this <br /> 49 section is administered consistent with its purpose. <br /> 50 (2) Permits. A permit is required for the construction of buildings or building additions (including <br /> 51 construction of decks and signs),the installation and/or alteration of sewage treatment systems, <br /> Page 88 of 141 <br />
