1 vegetation removal consistent with section 920(I) and land alterations consistent with section <br /> 2 920(J). <br /> 3 (3) Variances. Variances to the requirements under this section may only be granted in accordance <br /> 4 with Minn. Stats. § 462.357 and must consider the potential impacts of variances on primary <br /> 5 conservation areas, public river corridor views, and other resources identified in the MRCCA <br /> 6 plan. In reviewing the variance application, the City of Ramsey shall: <br /> 7 a. Evaluate the impacts to these resources. and if negative impacts are found, require <br /> 8 conditions to mitigate the impacts that are related to and proportional to the impacts, <br /> 9 consistent with Section 220 of this chapter and <br /> 10 b. Make written findings that the variance is consistent with the purpose of this section, as <br /> 11 follows: <br /> 12 1. The extent, location and intensity of the variance will be in substantial compliance <br /> 13 with the MRCCA plan; <br /> 14 2. The variance is consistent with the character and management purpose of the <br /> 15 MRCCA district in which it is located; <br /> 16 3. The variance will not be detrimental to PCAs and PRCVs nor will it contribute to <br /> 17 negative incremental impacts to PCAs and PRCVs when considered in the context <br /> 18 of past,present and reasonable future actions; and <br /> 19 4. The variance will not negatively impact(other MRCCA plan-identified resources). <br /> 20 (4) Conditional and interim use permits. All conditional and interim uses, required under this <br /> 21 section, must comply with Minn. Stats. § 462.3595 and must consider the potential impacts on <br /> 22 primary conservation areas, public river corridor views, and other resources identified in the <br /> 23 MRCCA plan. In reviewing the application, the City of Ramsey shall: <br /> 24 a. Evaluate the impacts to these resources and if negative impacts are found, require <br /> 25 conditions to mitigate the impacts that are related to and proportional to the impacts, <br /> 26 consistent with Section 235 of this chapter and <br /> 27 b. Make written findings that the conditional use is consistent with the purpose of this <br /> 28 section, as follows: <br /> 29 1. The extent, location and intensity of the conditional use will be in substantial <br /> 30 compliance with the MRCCA plan; <br /> 31 2. The conditional use is consistent with the character and management purpose of <br /> 32 the MRCCA district in which it is located; <br /> 33 3. The conditional use will not be detrimental to PCAs and PRCVs nor will it <br /> 34 contribute to negative incremental impacts to PCAs and PRCVs when considered <br /> 35 in the context of past,present and reasonable future actions; and <br /> 36 4. The conditional use will not negatively impact (other MRCCA plan-identified <br /> 37 resources). <br /> 38 (5) Conditions of approval. The City of Ramsey shall evaluate the impacts to PCAs,PRCVs, and <br /> 39 other resources identified in the MRCCA plan, and if negative impacts are found, require <br /> 40 conditions to mitigate the impacts that are related to and proportional to the impacts.Mitigation <br /> 41 may include: <br /> 42 a. Restoration of vegetation identified as "vegetation restoration priorities" identified in the <br /> 43 MRCCA plan; <br /> 44 b. Preservation of existing vegetation; <br /> 45 C. Stormwater runoff management; <br /> 46 d. Reducing impervious surface; <br /> 47 e. Increasing structure setbacks; <br /> 48 f. Wetland and drainageway restoration and/or preservation; and <br /> 49 g. And other conservation measures. <br /> 50 (6) Application materials. Applications for permits and discretionary actions required under this <br /> 51 section must submit the following information unless the zoning administrator determines that <br /> 52 the information is not needed: <br /> Page 89 of 141 <br />
