Case #6: Report on Waltek Sewer and Water Extension

City Engineer Jankowski reminded the Committee that at the March Public Works Committee
meeting, it was discussed that Waltek was anticipating an expansion, which involved the
extension of sewer and water past three other parcels. One parcel is vacant and owned by the
MPCA; Champlin Towing and Koenig Insulation occupy the other two parcels. Both of these
businesses have been contacted and indicated they would not be in favor of the extension of
sanitary services if they would be assessed the standard costs associated with the City's
assessment process. The Waltek site plan is anticipated being sent to the Council on April 27,
1999. The development agreement will address the sewer and water extension. Waltek should
be advised of the City's intention for extending sewer and water.

Councilmember Haas Steffen inquired how the Charter amendment pertains to this. She
understood the City would not be able to assess against them.

Mr. Jankowski understood that the amendment pertains only to residential.

Councilmember Haas Steffen thought that the amendment covers Citywide.

Councilmember Zimmerman stated he feels it's important to hook up to Waltek.

Councilmember Haas Steffen stated we have to do what we have done with other projects, we
have to ask the City Attorney. In the case of businesses - if they expand, she felt they should be
made to hook up.

Motion by Councilmember Haas Steffen and seconded by Councilmember Zimmerman to try to
get water and sewer to Waltek but because of a negative comment from the other two businesses,
we take this to our City Attorney and find out can we put a stipulation on those with regard to an
expansion.

Motion carried. Voting Yes: Councilmembers Haas Steffen and Zimmerman. Voting No:
None.

Case #7: Change Order No. 2 for Improvement Project #98-21 (Section 28 Sewer and
Water Extension) Bury & Carlson and Vision Ease

City Engineer Jankowski stated that Mr. Bury has asked to have concrete curb and gutter on the
west side of Jaspar all the way to his drive entrance. When Vision Ease did curb and gutter to
their rear entrance, it ran into Mr. Bury's property. When he (Jankowski) figured this out, he had
the curb removed, etc. When it is relayed, he will go to both these people and say this is your
portion of this project. Bury is paying for new installation and we would be going to Vision
Ease to ask them to pay for correcting the problem. It will be about 360 plus feet of new curb
and gutter and that total is $6,500.

Motion by Councilmember Haas Steffen and seconded by Councilmember Zimmerman to
approve the change order with the stipulation that it not cost the City any money.

Public Works Committee/April 20, 1999
