Mrs. Kalstabakken stated that she was watching a previous City Council meeting and heard the <br />City Attorney state in regards to a project that some businesses weren't in favor of that they had <br />the right to petition against the project and if three of the businesses signed the petition the <br />project could be stopped. She questioned why the Sunwood Drive residents did have the <br />opportunity to stop the extension of Sunwood Drive when well over 50 percent of the residents <br />are opposed to the project. <br /> <br />Councilmember Zimmerman explained that the project the City Attorney was referring to was a <br />public improvement project that the benefited properties would be assessed for. <br /> <br />Mrs. Kalstabakken questioned if they will be assessed for any of the project costs. City Engineer <br />Jankowski replied no. She questioned if they will still be assessed for sealcoating projects. <br /> <br />City Engineer Jankowski explained that sealcoating projects require a public hearing and are <br />assessed to the property owners. <br /> <br />Mr. Prody questioned if they will be assessed for any overlaying projects. <br /> <br />City Engineer Jankowski explained that currently overlaying projects are assessed to property <br />owners that front the road. <br /> <br />Mr. Roschen questioned if the existing plans affect any wetlands. <br /> <br />City Engineer Jankowski explained that a small area would be affected, but it will be mitigated to <br />another area. He noted that they are required a two for one on any wetlands that are affected. <br /> <br />Mr. Roschen noted that the City will need a permit to touch any wetlands. <br /> <br />City Engineer Jankowski stated that the City has a permit. <br /> <br />Mr. Roschen stated that he was told by Tom Hovey? that no permit has been given to the City as <br />of yet. <br /> <br />Mr. Prody questioned if any studies have done of the area to determine if any endangered species <br />live within the affected areas. <br /> <br />City Engineer Jankowski replied that the study was included as part of the environmental review <br />and there was no mention of any endangered species. <br /> <br />Mrs. Kalstabakken questioned if they City will request bids for both a concrete and bituminous <br />trail. <br /> <br />Public Works Committee/August 31, 1999 <br /> Page 5 of 10 <br /> <br /> <br />
