Councilmember Hendriksen stated he does not want at some point in the future to be told <br />we have a commitment if we do not want to approve it - it has to come back for land use <br />approval. <br /> <br />Mr. Johnson stated that they need a resolution by the City agreeing to sell this second site <br />to ACCAP for a certain price and that would allow them to make an application by <br />February 18. This would be subject to all the other normal approvals. We are talking <br />about doing something on this site that would be approved by the City. <br /> <br />Motion by Councilmember Haas Steffen and seconded by Councilmember Hendriksen <br />that the City shall create a Tax Increment Financing District for financing the ACCAP <br />Housing development, contingent upon the following: (1) City approval, including site <br />plan, zoning and subdivision approval if necessary for a specific ACCAP housing <br />development site; and (2) The securing of low income housing tax credits from the <br />Minnesota Housing Finance Agency. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Hendriksen, <br />Anderson and Zimmerman. Voting No: None. <br /> <br />Case #2: <br /> <br />Request for a Conditional Use Permit for a Cellular Telephone Base <br />Station; Case of AirTouch Communications, Inc. <br /> <br />Zoning Administrator Frolik reported that the City has received an application from <br />AirTouch Communications, Inc. to construct and operate a cellular telephone base station <br />at 9539 Highway #10, which is occupied by Frank's R.V. Service owned by Frank <br />Moody. The applicant is proposing to construct a 159-foot, self-supporting tower (165 <br />feet including antenna) in the northeast comer of the site. The tower will be <br />encompassed on three sides by a security fence that abuts the 12' x 24' equipment <br />building on the fourth side. The equipment building exterior will consist of a <br />maintenance-free, brown mineral finish. Because the site is part of a parking lot, no <br />landscaping is being proposed to screen the tower base and equipment building. <br />However, there are some existing trees in the vicinity of the tower that fulfill the <br />screening requirements. All setback requirements have been met. Ms. Frolik explained <br />that no new tower shall be approved unless the Council finds that the equipment planned <br />for the proposed tower cannot be accommodated on an existing tower or building within <br />a one-half mile radius of the proposed tower. There are no tall buildings in the one-half <br />mile search area but there is an existing tower approximately .3 miles away from the <br />proposed tower. The applicant has stated that this existing tower (120 feet) is not high <br />enough to meet their transmission needs. There is no way of verifying this other than <br />verbal. Ms. Frolik reported that the Planning Commission conducted a public hearing on <br />January 5, and hearing no verbal or written comment, recommended Council approve the <br />request.
