Councilmember Hendriksen stated he does not want at some point in the future to be told we have a commitment if we do not want to approve it - it has to come back for land use approval. Mr. Johnson stated that they need a resolution by the City agreeing to sell this second site to ACCAP for a certain price and that would allow them to make an application by February 18. This would be subject to all the other normal approvals. We are talking about doing something on this site that would be approved by the City. Motion by Councilmember Haas Steffen and seconded by Councilmember Hendriksen that the City shall create a Tax Increment Financing District for financing the ACCAP Housing development, contingent upon the following: (1) City approval, including site plan, zoning and subdivision approval if necessary for a specific ACCAP housing development site; and (2) The securing of low income housing tax credits from the Minnesota Housing Finance Agency. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Haas Steffen, Hendriksen, Anderson and Zimmerman. Voting No: None. Case #2: Request for a Conditional Use Permit for a Cellular Telephone Base Station; Case of AirTouch Communications, Inc. Zoning Administrator Frolik reported that the City has received an application from AirTouch Communications, Inc. to construct and operate a cellular telephone base station at 9539 Highway #10, which is occupied by Frank's R.V. Service owned by Frank Moody. The applicant is proposing to construct a 159-foot, self-supporting tower (165 feet including antenna) in the northeast comer of the site. The tower will be encompassed on three sides by a security fence that abuts the 12' x 24' equipment building on the fourth side. The equipment building exterior will consist of a maintenance-free, brown mineral finish. Because the site is part of a parking lot, no landscaping is being proposed to screen the tower base and equipment building. However, there are some existing trees in the vicinity of the tower that fulfill the screening requirements. All setback requirements have been met. Ms. Frolik explained that no new tower shall be approved unless the Council finds that the equipment planned for the proposed tower cannot be accommodated on an existing tower or building within a one-half mile radius of the proposed tower. There are no tall buildings in the one-half mile search area but there is an existing tower approximately .3 miles away from the proposed tower. The applicant has stated that this existing tower (120 feet) is not high enough to meet their transmission needs. There is no way of verifying this other than verbal. Ms. Frolik reported that the Planning Commission conducted a public hearing on January 5, and hearing no verbal or written comment, recommended Council approve the request.
