Ms. Sherman added that with a PUD, the City controls the uses. The City writes special
uses into permits in a sensitive area.

Ms. Sherman stated that Councilmember Haas Steffen's concern about 167th and the
current problem with sewer and if we are restrictive enough. All we say is that we will
limit what can happen in that area.

Councilmember Haas Steffen commented that we do have the ability to be restrictive if
there are some concerns. We have said we would like to see that area restricted - if we
are not restrictive enough, maybe we do have to talk about it.

Councihnember Hendriksen mentioned the intersection of 167th and T.H. #47 and asked
what's the objection.

Councilmember Haas Steffen stated she is concerned if we have been restrictive enough
given the difficulties there. Suppose the building that currently houses the grocery store
is vacated, what ability do you have to control what goes in there - so we will not have
the same septic system.

Ms. Sherman stated it's somewhat beyond this. It's part of our septic system ordinance.
If they change, you have to update it to meet standards.

Councilmember Haas Steffen again asked, are we restrictive enough?

Ms. Sherman replied that it's probably more restrictive beyond this document. Maybe
that's a good area to do some redevelopment. Ms. Sherman noted the statement about the
septic system policy.

Councilmember Haas Steffen stated that she raised this issue because of the Metropolitan
Council's position on 2.5 acres. They do not appear to approve that type of development
unless you have some kind of septic inspection in the City.

Mayor Gamec replied, that's correct.

Councilmember Hendriksen suggested sending this the way it is and letting the Met
Council tell us what they want beyond 7080.

Ms. Sherman added that there is also a chance to learn more at that seminar they are
planning to attend.

Councilmember Haas Steffen agreed it could be sent through and ask them to be very
specific.

Councilmember Hendriksen added that he also felt that before the document is
forwarded, we should have "all our ducks in a row".

Special City Council/March 30, 1999
