Case//7: <br /> <br />Request for Preliminary Plat Approval of Northfork Itasca Point; <br />Case of Northfork, Inc. <br /> <br />Zoning Administrator Frolik stated that North Fork, Inc. is requesting preliminary plat <br />approval of another portion of the Northfork P.U.D. located on the north side of Lake <br />Itasca. The plat is to be named Northfork Itasca Point and consists of approximately 35 <br />acres proposed to be platted into seven single family lots and permanent open space to be <br />deeded to the Homeowner's Association in the form of an outlot. The plat is in the shore <br />land overlay district for Lake Itasca and, as such, the lots are required to be at least <br />80,000 square feet in size and 200 feet wide at the road frontage or building setback line. <br />In addition, the riparian lots or lots adjacent to the lake (4, 5 and 6) are also required to be <br />200 feet wide at the water frontage and provide for a 200-foot structure setback from <br />ordinary high water mark and a septic system setback of 150 feet from ordinary high <br />water mark. Ms. Frolik pointed out that all the lots meet the shore land regulations with <br />one exception. Together, all of the lots total more than 1,400 feet of frontage at the street <br />frontage or building setback lines, but on a lot by lot basis, Lot 5 is shy of the 200-foot <br />mark. On May 4, 1999, the Board of Adjustment granted a variance to the 200-foot <br />width requirement on Lot 5 because there is at least 1,400 feet of road frontage among <br />the seven lots. She pointed out also that all of the riparian lots were also designed so that <br />the building pad could meet the 200-foot structure setback from ordinary high water <br />mark. However, because the DNR minimum setback from ordinary high water mark is <br />150 feet and because that setback in this case would require less tree removal and <br />disturbance of existing topography, the developer chose to also seek a variance from <br />Ramsey's current 200-foot requirement. The Board of Adjustment also approved this <br />variance request because compliance with DNR's minimum of 150 feet would be <br />maintained on all three of the riparian lots. Ms. Frolik reported that the lots are proposed <br />to receive public access from the extension of a cul-de-sac east off of Andrie Street. The <br />cul-de-sac length is approximately 1,000 feet and a variance to the 600-foot maximum <br />cul-de-sac length was also granted by the Board of Adjustment on May 4. The variance <br />was granted based on the fact that the subject area is basically a peninsula of developable <br />property not wide enough to accommodate a looped road system through the area. <br />Additionally, the preliminary plat proposes to name the street Itasca Point Road, which is <br />a deviation from the City's grid system and requires Council approval. Ms. Frolik noted <br />that in accordance with the Northfork Park Dedication Agreement dated May 9, 1989, <br />park dedication for this portion of the P.U.D. has been previously satisfied with land <br />dedication. The grading and drainage plan has been reviewed by the City Engineer and <br />he has recommended a modification consisting of an elongated sedimentation basin on <br />the common property lines of Lots 6 and 7. The developer is modifying the plan <br />accordingly. She noted that a tree preservation and planting plan also needs to be <br />provided. Ms. Frolik reported that the Planning Commission conducted the preliminary <br />plat public hearing on April 6, 1999, and no verbal or written comments were submitted. <br />The Planning Commission and City staff are recommending approval. She noted that <br />Dennis Peck, Director of Development, is present. <br /> <br />Councilmember Zimmerman commented on the permanent open space on the outlot and <br />what if residents decide they did not want to pay taxes on that and they give it back to the <br /> <br />City Council/May 25, 1999 <br />Page 13 of 25 <br /> <br /> <br />
