conducted a public hearing on June 1, 1999, regarding the request. There were no verbal or <br />written comments submitted. However, the Applicant did make a slide presentation of other <br />signs in the Highway/410 corridor. In his presentation he noted signs that appeared to be larger <br />than 100 square feet and taller than 35 feet. The visual presentation also identified a clutter <br />problem in the corridor due to trees, signs and power lines, that would obscure visibility of the <br />Burger King sign as you travel west on Highway #10. Ms. Frolik explained that subsequent to <br />the Planning Commission meeting, staff did meet with the applicant to review some of the <br />permits issued for other signs in the Highway #10 corridor. The records indicated the following <br />square footages on freestanding signs: Holiday R.V. - 100; Holiday Stationstore - 91 (however, <br />they received a conditional use permit in 1998 for an additional 31 square feet to accommodate a <br />reader board but when they revamped the signage in 1994, they decreased the freestanding sign <br />to 91 square feet); Lano Equipment - 100; Amoco - received a conditional use permit for 125 <br />feet to accommodate a reader board; Diamonds Sports Bar - 100; Comfort Suites - 93; Anoka- <br />Ramsey Sports Center - received a conditional use permit for 300. This doesn't mean that there <br />aren't some lawful, and most likely unlawful, non-conforming signs still in use along the <br />corridor. However, development along the highway has become more sophisticated and there is <br />a corresponding trend in compliance with the sign regulations; conditional use permits for <br />overages have been minimal in recent years. <br /> <br />Greg Clone, Dolphin Realty, stated that they just received notification that Burger King was <br />changing all of the signs with a new logo, which will be ready for production by August 15, <br />1999. He explained that the new sign is 113 square feet instead of the 100 square foot <br />requirement and that they are still requesting the 5x9-reader board and would stay with the 25- <br />foot height. <br /> <br />Councilmember Hendriksen questioned if there are other sizes to chose from. <br /> <br />Mr. Clone replied with the square sign they have a couple size options, but with the new sign he <br />thinks the 113 square foot sign is the only option. <br /> <br />Councilmember Hendriksen questioned why they don't they use the 10xl0 square sign. <br /> <br />Mr. Clone stated that he thinks that a 10xl0 sign would have to be custom made and with the <br />new logo they are going to be required to change signs and he thought it made more sense to put <br />the new sign up noting that an additional 13 square feet is not that much different. <br /> <br />Mayor Gamec stated that he doesn't think an additional 13 square feet would be a problem. <br /> <br />Planning Commission Chairperson Leo Anderson reviewed the discussion of the Planning <br />Commission. He stated that it was the Commission's understanding that 100 square feet was <br />ordinance and that Dolphin Realty came in with a request of 189 square feet. The Commission <br />looked for a reason to exceed the 100 square feet and found that some signs on Highway #10 <br />exceeded the 100 square foot. The Commission was told that Dolphin Realty had an option of an <br />8x8 or a 12x12 square sign and that a 10xl0 sign would have to be custom made.
