Councilmember Hendriksen stated that they need to follow the Charter and that Waltek needs to <br />petition the City for water and sewer, because if City Council authorizes the project then the City <br />is obligated to pay for the project. <br /> <br />City Attorney Goodrich noted that the Council has only agreed to the feasibility study. He stated <br />that he would review Chapter 8 of the Charter and verify the wording. <br /> <br />Councilmember Anderson requested information on deferring assessments, questioning who <br />pays the cost while the fee is being deferred. <br /> <br />Mayor Gamec requested that staff put together a cost projection, including Waltek's proposal of <br />paying the interest for two years on the neighboring properties and deferring the cost until the <br />land was connected to City sewer and water. <br /> <br />Mr. Koenig explained that during the meeting with City Engineer Jankowski, Mr. Bulenski <br />stated that Waltek had a signed agreement that the City would install the sewer and water. <br /> <br />Mayor Gamec stated that they would have to research the information. <br /> <br />Mr. Bulenski explained that on March 23, 1999, when the site plan was approved it included the <br />water and sewer coming to the property and that they have already installed water and sewer out <br />to the proposed location. <br /> <br />City Administrator Norman noted that there was no development agreement, only a site plan <br />approval, which does not obligate the City to install City water and sewer. <br /> <br />Mayor Gamec requested that more information be given to Council during the 60-day waiting <br />period and to possibly meet with the business owners again. <br /> <br />Case #2: <br /> <br />Introduce Ordinance to Vacate Drainage and Utility Easement in A.E.C. <br />Energy Park; Case of Direct Enclosures <br /> <br />Mayor Gamec closed the regular portion of the City Council meeting at 7:53 p.m. in order to <br />conduct a public hearing. <br /> <br />Public Hearing <br /> <br />Mayor Gamec called the public heating to order at 7:53 p.m. <br /> <br />Presentation <br /> <br />Zoning Administrator Frolik stated that Direct Enclosures recently received site plan approval <br />from the City to construct their new building on Lot 1, Block 2, A.E.C.
