setback. The driveway and off-street parking areas will be paved and finished with [L612 <br />curbing. The plat for Guy Addition provided two accesses to Highway #10 for the four lots. <br />According to the plat of Guy Addition, the Zitzloffproperty is supposed to access Highway #10 <br />via a 30 foot easement in the southwest comer of the adjacent lot to the east (Lot 3). The site <br />plan shows expanding that existing 30 foot driveway into a 50 foot wide access in an area where <br />no access rights exist (the southeast comer of Lot 2). The plan has been forwarded to Mn/DOT <br />for comment and written response was received at the City on October 4, 1999. Mn/DOT is <br />recommending that the common access in the southwest comer of Lot 2 (pawn shop parcel) be <br />relocated slightly to the west on the common property line of the pawn shop and Zitco parcel to <br />line up with the Highway #10 median crossing. This relocation of the legal access will require <br />the cooperation of Mn/DOT and property owners in Guy Addition. The process can be initiated <br />by Mr. Zitzloff at any time. No screening is required because the adjacent parcels are also zoned <br />commercial. The site plan provides the required 20 foot wide landscaped area parallel to <br />Highway #10 and, at Staff's request, an additional 20 feet has been preserved for a possible <br />future service road. Staff recommended, and the Applicant agreed, to add a couple more trees to <br />the plan. The facility will be serviced by municipal sewer and water. Because of pre-existing <br />stormwater problems in the area, the development will require stormwater improvements. <br /> <br />Councilmember Zimmerman inquired if Mr. Zitzloffhad any questions in regards to access. <br /> <br />Mr. Zitzloff replied that his architects are working on the issue. He stated that he did have one <br />concern over the trees. He did not mind adding additional trees, but he was concerned about <br />blocking the front of the businesses and he was thinking of a landscape plan that would utilize <br />the same amount of trees, but open up the front of the building. <br /> <br />Zoning Administrator Frolik replied a cluster plan would be appropriate. <br /> <br />Councihnember Hendriksen stated that it would be appropriate for the correct Staff person to <br />develop an appropriate landscape plan so that the building is not screened. He inquired how they <br />intend to construct the building in the proposed location when the water drains from the adjacent <br />property owner directly into the area. <br /> <br />Mr. Zitzloff explained that his architects have developed a wall that will drain the water to the <br />back of the property. <br /> <br />Councihnember Hendriksen replied that he is concerned that it will cause a flooding problem for <br />the neighbor. <br /> <br />Mr. Zitzloff stated that he has attempted to contact J.R.'s several times and has not received a <br />call back in regards to the drainage problems. He expressed that maybe J.R.'s will be forced to <br />deal with his water if it cannot drain through the property.
