Neither of these is occurring with this request. <br />Secondly, interim use permits, by definition, are limited to a maximum timeframe of five years. <br />While this is the first interim use permit request by RV World, Inc., as well as the first request <br />for this particular property, the interim use permits issued to B & A Cylinder were obtained for <br />RV World. This raises the question of how the five year time limit is applied. Mr. Trudgeon <br />stated staffhas been attempting to work with several of the RV dealerships along Highway I0 to <br />address the issue of surplus merchandise being displayed and/or stored on unimproved surfaces. <br />The goal is to get the properties to comply with current zoning regulations that require <br />memhandise to be stored on an unimproved surface with curbing. Staff believes that a request of <br />this type may be reasonable if the intent were to provide the applicant time to make certain on- <br />site improvements necessary to comply with City Code. However, this is the third attempt at a <br />temporary fix without any apparent plans for needed improvements or expansion of RV World's <br />existing site. <br /> <br />Community Development Director Trudgeon advised the Planning Commission held a public <br />hearing and reviewed the request at their May 4, 2006 meeting. The Planning Commission <br />recommended approving an interim use permit until September 30, 2007. Based on the <br />aforementioned concerns, staff is of the opinion that the request should be denied. <br /> <br />Councilmember Cook asked if the land the RVs are parked on is being leased. <br /> <br />Community Development Director Tmdgeon replied as he understands there is a <br />verbal/handshake agreement. <br /> <br />Councilmember Cook suggested land the City has purchased for right-of-way on Highway 10 <br />could be leased to companies like this, as this land is properly set up and zoned for this type of <br />use. <br /> <br />Councilmember Elvig concurred. He noted this would fly in the face of trying to clean up <br />Highway 10, but that will not happen until the highway project is completed. If this were to be <br />done in a neat, orderly fashion it would be more orderly than storing the RVs on farmland. The <br />business owners would likely appreciate this more, as it would be more exposure for them. <br /> <br />Councilmember Cook expressed concern in granting this permit in an R-1 area. He stated there <br />are already problems with people in R-1 areas thinking they can have a number of vehicles and <br />doing business out of their pole bams. <br /> <br />Mayor Gamec noted there was a stipulation applied after the B & A Cylinder permit that there <br />would not be any more storage unless it is on the business' premises or an impervious surface. <br /> <br />Community Development Director Tmdgeon indicated in this particular case RV World knew <br />the process and did not approach staff. There are other pieces of land that would support this <br />type of use, rather than .the City receiving a complaint, tracking it down, and going through this <br />process. If the City and the business owner could find a solution and work together there should <br />be an ability to accommodate in certain areas. If there were to be a five acre parcel in the middle <br />of a residential subdivision to the north this type of use would not be acceptable in anyone's <br />imagination. <br /> <br />City Council / May 23, 2006 <br />Page 8 of 20 <br /> <br /> <br />
