Mr. Gordon stated that is correct and will be addressed through the Town Center which has a <br />component of mixed use. <br />Councilmember Hendriksen asked if B-1 or B-2 designation would be seen within the land use <br />designation of Mixed Use. <br />Mr. Gordon stated he cannot say that since work is not yet done on the Town Center and it is not <br />known how that would apply to mixed use. <br />Mr. Gordon reviewed the use chart, noting comments from the last meeting were to look at a way <br />to allow animal clinics with boarding facilities. He noted the permitted use chart which expands <br />animal clinics to include boarding facilities. <br />Councilmember Anderson questioned the adult uses and her impression it was to be included in <br />industrial. She asked if this was to address a video shop with small back room for restricted <br />videos. <br />Mr. Gordon stated that is correct and is how it is being addressed today. He noted that outside <br />animal boarding would require a conditional use permit. Another concern was that daycares were <br />listed as a permitted use in the B-1 District. <br />Councilmember Zimmerman asked if the City checked to see if the ordinance has the proper <br />amount of adult uses as required by the conditions of the law suit. <br />Associate Planner Wald stated the City had to designate the BW district for adult uses and that <br />has been done. That name will be changed but the location will not be changed. <br />Councilmember Zimmerman again asked staff to verify that the conditions of the lawsuit have <br />been followed. <br />Mr. Gordon reviewed the issues discussed with the parking as set back from the right-of-way. <br />There were two different standards in the Business District. In addition, the City did not want <br />sales and displays located outside in the B-1 District so that was stricken. Other changes <br />addressed the 20 foot setback. He noted that items for sale at gas stations displayed on a rack <br />outside would not be permitted in the B-1 District of the Highway #47 corridor. Mr. Gordon <br />reviewed the use chart which specifically states "without outdoor activities." Also, the accessory <br />use section does not allow outside displays. <br />Mayor Gamec stated this may cause a problem for gas stations that store small propane tanks for <br />grills outside. <br />Mr. Gordon stated the gas stations are convenience gas which includes a retail store but not <br />repair. That would require a conditional use permit so the City could allow outdoor storage of <br />small propane tanks to occur through the permitting process. <br />Chapter 9 Committee /June 27, 2002 <br />Page 2 of 11 <br />
