Councilmember Kurak asked what will happen with the existing gas stations that have outdoor <br />storage. <br />Mr. Gordon stated they would be grandfathered until they wanted to remodel or expand. <br />Mayor Gamec noted this would restrict the display of flowers, bedding plants, salt, or firewood <br />from convenience stores too. He noted that some of these items are nicely displayed. <br />Councilmember Hendriksen stated there are extremes where some have things nicely displayed <br />while other businesses have their items for sale spilling into the right-of-way. <br />Councilmember Anderson suggested the restrictions be considered so it can be addressed through <br />the conditional use permit and some control provided. <br />Councilmember Hendriksen asked if that implies that any use not listed under conditional uses in <br />the ordinance cannot be granted. <br />Mr. Gordon stated that is correct and if the use is not listed, the Council cannot consider a special <br />use permit. The uses listed on the use chart are the only ones the Council can consider unless a <br />use is added to the use chart. <br />Councilmember Hendriksen stated if a use is overlooked and not included in the ordinance, the <br />Council does not have the option to consider it through the special use process. He noted that the <br />only way to consider a new use is to amend the ordinance to include it. <br />Planning Commissioner Reeve asked if the applicant could appeal that use to the City Council. <br />Mayor Gamec stated there is no appeal process for that type of situation. <br />Councilmember Hendriksen noted the number of uses included on the use chart and his belief that <br />other uses will come forward over the course of time. <br />Mr. Gordon explained that most uses will fall into retail activities, offices, and personal and <br />professional services. A use such as a convenience gas station would need a conditional use <br />permit. <br />Councilmember Hendriksen stated it seems the ordinance goes out of its way to define some uses <br />such as commercial car washes and he wonders if a use list with six or so entries can cover all <br />uses that could come up. He asked if a caveat should be included to allow additional uses as <br />permitted or something that allows the City to avoid having to change the Zoning Ordinance <br />every time a use comes up that is not specifically named. <br />Mr. Gordon stated that is a good comment and language can be included to indicate the Council <br />or staff will find a fit for the use within a district. <br />Chapter 9 Committee /June 27, 2002 <br />Page 3 of 11 <br />
