Mayor Gamec stated this will restrict it more and allow applicants to talk with staff which may be <br />easier than talking to the City Council. It also sets up a procedure that needs to be followed. <br />Councilmember Hendriksen stated conditional uses are required since some uses may or may not <br />be acceptable in all locations. The conditional use process looks closer at the use and whether it <br />fits with the intent of the area. He stated he would not ever want to allow a conditional use by a <br />staff person. <br />Mayor Gamec agreed the Council likes that authority and it does take the pressure off staff who <br />may be reluctant to make such a decision. <br />Planning Commissioner Reeves agreed that the decision should rest with the Council and require a <br />public hearing. <br />Mr. Gordon stated language will be added to allow the Council to make that use determination. <br />Councilmember Anderson asked what happened with restaurants. <br />Mr. Gordon stated that was discussed but it was not decided that outdoor restaurant patios <br />should be regulated in some form. However, outdoor athletic activities, such as volleyball, were <br />discussed. <br />Mr. Gordon noted that The Diamonds is in a B-2 District since it is along Highway 10. <br />Planning Commissioner Reeve stated the concern is having a restaurant along Highway 10 with a <br />patio in back. <br />Councilmember Hendriksen noted that McDuffs also has outdoor seating. <br />Mayor Gamec noted that Northfork is another area with outdoor seating. <br />Councilmember Zimmerman agreed it would be good to control so you could weed out activities <br />that are undesirable. <br />Mr. Gordon asked if the Council wants to regulate outdoor restaurant seating areas. <br />Planning Commissioner Reeve stated it may not be a bad idea. <br />Councilmember Hendriksen stated if the restaurant comes to the conclusion they can serve food <br />outside then the pet food store may conclude they can store product outside and sell it. <br />Planning Commissioner Reeve agreed both are for sale. <br />Councilmember Anderson stated there is some area in-between where they have a patio during the <br />summer and then it is covered with a tarp in the winter time. <br />Chapter 9 Committee /June 27, 2002 <br />Page 4 of 11 <br />
