Mayor Gamec noted the Health Code also has stringent requirements on outdoor patio eating <br />areas or outdoor food vendors. <br />Mr. Gordon stated that any time you allow outdoor storage of product when located by <br />residential, it promotes unsightliness and other things you don't want to see. However, outdoor <br />restaurant seating only happens during nice weather and certain hours of the day. <br />Councilmember Zimmerman asked if there is a different definition for "outdoor." <br />Mr. Gordon stated it would be outside the walls of the building. <br />Councilmember Hendriksen stated that a restaurant with outdoor seating results in outdoor sales <br />but a store with outdoor display of merchandise can be brought inside so there is no outdoor <br />sales. <br />Mr. Gordon stated the City can either not address outdoor seating and allow it to happen, or it <br />can be called out and defined. <br />Mayor Gamec stated he does not object to regulating it and if littering is a problem, the City can <br />address it anyway. In addition, the Health Department has many requirements they must follow. <br />Consensus was reached to leave Subdivision 2, item a and b as written <br />Mayor Gamec stated he hates to see a convenience store have to apply for a permit to have an <br />outdoor display of salt or flowers. He suggested staff address how to correct flagrant violators <br />that become a problem. <br />Councilmember Hendriksen noted the other extreme is the business at Sunfish and Highway 10 <br />where every square inch of the property is covered with merchandise to the point that employees <br />have to park on the adjoining lot. <br />Mr. Gordon suggested Subdivision 4, item e, be reconsidered and a threshold be established with <br />a maximum percentage or size of the building restriction. <br />Mayor Gamec suggested the Blaine ordinance be reviewed to see how they deal with outdoor <br />storage. <br />Planning Commissioner Reeve agreed that sometimes there is no reason for the convenience <br />stores to have that much stock on hand. <br />Councilmember Hendriksen asked if restrictions will be placed on the sale of agricultural products <br />like flowers and trees. <br />Mr. Gordon stated they would be restricted if located outside. <br />Chapter 9 Committee /June 27, 2002 <br />Page 5 of 11 <br />
