Planning Commissioner Reeve noted that landscaping nurseries have outdoor storage of their <br />plantings. <br />Mr. Gordon stated the nursery would be in the B-2 District. <br />Councilmember Hendriksen stated he does not want to outlaw nurseries in Ramsey. <br />Mayor Gamec noted there are a number of nursery businesses in Ramsey. <br />Consensus was reached to review the language for nurseries and outdoor display of merchandise. <br />Councilmember Hendriksen stated if a nursery was considered an existing non -conforming use, <br />the question is raised about the point they lose that grandfathering. He noted it had been <br />mentioned that when they remodel or expand it would be lost and then they would be out of <br />business. Councilmember Hendriksen stated that could come about due to a storm that damages <br />the building which would also require meeting ADA requirements. <br />Mr. Gordon stated that an upgrading would be allowed under the non -conforming status as long <br />as it does not get into structural issues or change in size. If a storm damaged the building more <br />than 50% then the use could not go back in there. If less than 50%, then the business could <br />rebuild. He agreed that the amount of nursery stock, which fluctuates throughout the year, is not <br />regulated. <br />He asked if interim use permits should be considered. <br />Mr. Gordon stated that is addressed and some uses could be listed as being allowed in every <br />zoning district. However, that is different than a permanent or temporary use since a time is set <br />for how long it can exist. <br />Councilmember Hendriksen stated that once the conditional use permit is granted it is there <br />forever as long as the conditions still apply. The interim use permit was created to allow a <br />temporary use for a certain period of time until the ultimate use of the property is timely. <br />Mr. Gordon stated this ordinance calls uses out differently and calls it out in a separate section. It <br />is not addressed specifically to any zone. <br />Councilmember Hendriksen asked if it will say that interim uses apply to all zoning districts under <br />Council discretion. <br />Mr. Gordon agreed that is the approach.
