Councilmember Hendriksen asked if the 25% is being multiplied with the total number. <br />Mr. Gordon answered affirmatively and explained that the percentage is based on the baseline. <br />Councilmember Hendriksen suggested the language be made clear so a developer coming in can <br />clearly understand what the landscape requirements are. He also suggested the formula be <br />included in the ordinance. <br />Mayor Gamec stated staff works with the landscaping plan. <br />Councilmember Hendriksen stated that ultimately City Attorney Goodrich has to be able to <br />defend and enforce it in court. He suggested the easiest way is to describe how it is calculated. <br />He suggested that Attorney Goodrich be asked to determine how many trees would be required <br />based on the language included in the ordinance. <br />Mayor Gamec noted that staff reviews the landscaping plan and determines the landscaping <br />requirement, not the City Attorney. <br />Councilmember Hendriksen stated he does not think a judge would arrive at the same number of <br />landscaping plants as has been described tonight. <br />Councilmember Anderson noted that under planting types, #2, indicates "be not" which should be <br />revised to indicate "shall not." <br />Mayor Gamec stated some people have said the Council is not making progress with this process <br />and asked how this discussion can be moved farther along rather than focusing on the <br />micromanagement issues. He stated it had been thought this would take two or three meetings <br />but this is the fifth meeting. He asked for suggestions on how the process can move forward. <br />Mr. Gordon stated there might be another way to review it since staff is ahead of what the <br />Subcommittee is looking at tonight. However, they want to keep all involved in the process. He <br />suggested that all of the information be given to the Subcommittee so it can be looked at as a <br />whole rather than going through it individually by section. <br />Mayor Gamec stated the Council is involved with setting policy and staff does the <br />implementation. <br />Councilmember Hendriksen stated he is not sure who said this process is not moving fast enough <br />but the last time there was a complete rewrite, he was serving on the Planning Commission and <br />they worked on it for roughly 18 months. He stated it is unrealistic to think the City can <br />completely rewrite the entire zoning chapter in two meetings. Councilmember Hendriksen stated <br />he believes the City is making horrendous changes to how the City will be zoned, completely done <br />away with R-1 rural zoning, and is now going by lot sizes no matter where you are in the City. <br />He stated the ripple effect of that will be horrendous.
