23. <br /> <br />24. <br /> <br />25. <br /> <br />26. <br /> <br />27. <br /> <br />28. <br /> <br />29. <br /> <br />30. <br /> <br />31. <br /> <br />32. <br /> <br />33. <br /> <br />34. <br /> <br />35. <br /> <br />That the Applicant has been issued a Hazardous Waste Generators License by <br />Anoka County Environmental Services relating to the solvents that are used in the <br />disassembly of engines and transmissions and the collection of oils. <br /> <br />That MPCA rules or Anoka County regulations do not require any special <br />permitting for the collection of non-hazardous metals or batteries as long as the <br />batteries are stored in an acid resistant container. <br /> <br />That the collection of the other non-hazardous metals and batteries qualifies as a <br />solid waste management facility under Chapter 9.14 of the Ramsey City Code, for <br />which conditional use permit terms are limited to 5 years. <br /> <br />That the proposed use will substantially adversely impair the use, enjoyment or <br />market value of any surrounding property. <br /> <br />That the current operating conditions at the subject facility are not in compliance <br />with the conditional use permit presently in effect. <br /> <br />That the proposed use will be designed, constructed, operated and maintained so as <br />to be harmonious and appropriate in appearance with the existing or intended <br />character of the general vicinity and will not change the essential character of the <br />area. <br /> <br />That the proposed use may create excessive additional requirements at public cost <br />for public facilities and services. <br /> <br />That the proposed use may involve uses, activities, processes, materials and <br />equipment and conditions of operation that may be detrimental to persons, property <br />or the general welfare by reason of excessive production of smoke, fumes and <br />odor. <br /> <br />That the proposed use may involve uses, activities, processes, materials and <br />equipment and conditions of operation that may be detrimental to persons, property <br />or the general welfare by reason of excessive production of glare, noise or traffic. <br /> <br />That the proposed use will not be unduly dangerous or otherwise detrimental to <br />persons residing or working in the vicinity or to the public welfare. <br /> <br />That the proposed use will be consistent with the intent and purposes of Chapter <br />9.03.04 (Conditional Use Permits) of the Ramsey City Code. <br /> <br />The City of Ramsey has established a position that when a site receives discarded <br />materials and processes these materials into an end product with value on the site, <br />then it is considered a manufacturing operation. When a site receives discarded <br />materials and transfers those materials to another site for processing into a product <br />with end value, that the site where it is received is considered to be a solid waste <br />management facility. <br /> <br />That two members of the City Council and three members of the Planning and <br />Zoning Commission toured Danny's Aluminum Processing facility on August 31, <br />1992. <br /> <br /> <br />
