Public Works Director Olson stated the ordinance is very specific about the percent of <br />impervious surface and how the rates are calculated. In most cases communities that have <br />implemented stormwater utility fees have identified land classes and made assumptions based on <br />the percent of impervious surface. Ramsey calculated each property, which was extremely time <br />consuming, but also extremely accurate. <br /> <br />Councilmember Pearson inquired about the amount of adjustment that could be received if the <br />site meets the criteria of the credit application. <br /> <br />Public Works Director Olson reviewed the available credits, which total 50% that is available in <br />credits, none of which have been applied for in this case. <br /> <br />Mr. Rowe stated when he inquired about the possibility of using the pond for his drainage area, <br />rather than the expense of building a pond, he was informed by staff that it could be done except <br />that he does not own all the land surrounding it. <br /> <br />Public Works Director Olson stressed that water needs to be cleaned before it drains to a <br />wetland. That is not to say the pond cannot be used for credits, but there would need to be <br />complete control of the drainage; this pond could not be maintained because it cannot be dug out <br />every few years. <br /> <br />Chairperson Elvig noted the first issue is the drainage into the pond, which would need to be <br />facilitated by the WMO or DNR. Mr. Rowe may be able to obtain an easement to drain to this <br />pond, but the DNR will likely require that a pond be dug to treat the water before it goes into that <br />wetland. <br /> <br />Mr. Rowe stated that water from homes and driveways drain into the wetlands. <br /> <br />Fire Chief Kapler explained developers are required to apply for ponding when a new housing <br />development is built, and every house is part of that drainage system. <br /> <br />Mr. Rowe stated he is not against paying a fee, but this rate has gone up too much, too fast; the <br />increase should be reasonable. <br /> <br />Public Works Director Olson encouraged Mr. Rowe to apply for the available credits, although <br />there will be improvements required to obtain the credits. He explained by going through site <br />plan approval for the extension of existing buildings they can plan for the improvements and <br />point the individual in the right direction when entering into a project, rather than after the fact. <br /> <br />Chairperson Elvig noted the possibility of a linear pond on the site. <br /> <br />Motion by Chairperson Elvig, seconded by Councilmember Olson, to recommend to the City <br />Council that the appeal by Mr. Rowe be denied and the property be billed at the new rate of <br />$2,953.69/qtr, and that the rate can be adjusted if the site meets the criteria on the credit <br />application. <br /> <br />Public Works Committee / May 16, 2006 <br /> Page lOof16 <br /> <br /> <br />
