So whereas in some cases the consultant has been held to correct a situation, this Town Center area has been very fluid with regards to what has been estimated, what has been paid for, and what has been designed. The design on Sunwood Drive was changed basically overnight. The consultant has been responsive to the City's needs to correct and change things. He would rather not take the opportunity to ask the consultant for reimbursement for the bituminous removal, which is about the only thing they could be held accountable for. Chairperson Elvig expressed his agreement with Mr. Olson's assessment of the consultant's responsibility. He commented that the consultant has been right there with the City in making things work with Ramsey Town Center. He inquired about the possibility of breakage with the end points as outlined in the design. City Engineer Jankowski indicated this concern was also noted by staff. Chairperson Elvig inquired if this pavement area should be articulated by some type of stamping. Public Works Director Olson indicated the sidewalk is scored and brushed differently. There is no longer an opportunity to brush the areas that have been constructed, but it could be scored differently. Motion by Chairperson Elvig, seconded by Councilmember Olson, to recommend to City Council that a change order be authorized for Option One in the amount of $11,635.00. Further discussion: Chairperson Elvig reiterated that the design of the end points should be reevaluated. Motion carried. Voting Yes: Chairperson Elvig, Councilmembers Olson and Pearson. Case #4: Consider Change Order for Improvement Project 05-23 Ebony Street Sewer Water and Street Improvements City Engineer Jankowski reviewed at the conclusion of the 2005 construction season the contractor for this project requested consideration of a number cost increases based upon changes encountered during the construction. Included in the Committee's packet is Change Order No I, which describes each changed item for which staffis recommending approval, along with justification for each change. The total amount of the changes is $8,117. All of the changes relate to storm water issues and the increase cost will be charged to the storm water utility. Mr. Jankowski provided an overview of the changes. He advised staff recommends that the Committee recommend to City Council approval of Change Order No. 1 in the amount of $8,117 to be funded from the Storm Water Utility. Motion by Councilmember Pearson, seconded by Councilmember Olson, to recommend to City Council approval of Change Order No 1 in the amount of $8,117 to be funded from the Storm Water Utility.
