Councilmember Elvig noted finding no. 14 <br />specifically spells out residential and agricultural land; it reasonably considers that there may be <br />a misunderstanding regarding these zonings. Mr. Moiner stated staff sent him maps of what RV <br />World could perhaps look at using for a permit; and in looking at some of the locations, they are <br />much more in the public eye than this piece of land. If the denial of this permit has anything to <br />do with other people seeing what is going on and someone else wanting to apply for a permit, <br />this piece definitely raises less eyebrows for the general public, other than by his competition <br />down the street. Frolik explained the <br />major difference is that the possible locations sent to Mr. Moiner are zoned commercial or <br />places-to-work; none of this site is zoned commercial. Councilmember Cook stated the issue is <br />the appropriate use of zoning. If RV World is granted an interim use permit to park their <br />vehicles in a residential area, even if this is out in the middle of nowhere, the next person may <br />come in next to someone's house and use this permit as an example of the City allowing this <br />parking to be done on residential property. The Council does not care if the vehicles are parked <br />in the public view on Highway 10; the zoning must be appropriate. Mr. Moiner explained what <br />he is saying is that more eyebrows will be raised with the locations that have been suggested by <br />staff. The vehicles will be more in the public eye than on the property where he has them stored. <br />He would hope every case stands on its own. Councilmember Cook stated every case cannot be <br />treated on its own; precedence is set and everyone in the City must be treated equally. Mr. <br />Moiner stated he sat in a Council meeting about one month ago when there was a debate about <br />the length of cul-de-sacs; one was allowed and another was not, so it is not a cut and dried case. <br />Councilmember Elvig noted the Planning Commission approved this as an interim use. He <br />appreciates Mr. Moiner's concerns about Highway 10. The City is trying to clean up Highway <br />10, but there is a period of time where they will have to live with what is there; the transition of <br />the roadway and improvements will have to come over a multitude of years. Regarding the <br />parking of these RV's on agricultural property, the Council is interested in putting them on <br />Highway 10 where it is more appropriate, rather than zoning them back into something like this <br />agricultural property. This would likely be a positive for RV World, as it would provide them <br />with more exposure. The Council would ask that the RV's are stored neatly, which RV World <br />already does on their property. Mr. Moiner stated RV World will work with the City and try to <br />do a better job hand in hand to resolve their problem. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Jeffrey, Elvig, Olson, and <br />Pearson. Voting No: None. Absent: Councilmember Strommen. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Elvig, to adopt Resolution #06- <br />06-177 to deny the interim use permit based on findings of fact, and to allow the applicant until <br />October 31, 2006 to comply with the denial. <br /> <br />Further discussion: Councilmember Elvig strongly encouraged staff to assist the applicant in <br />finding another spot for these vehicles. Mr. Moiner stated he had previously asked if the City <br />had an interest in renting some of its property, and was told the City would not have an interest <br />in doing that. It may be that this was a recent idea for the City to lease out its property. <br />Councilmember Cook clarified he is not against RV World storing their RV's in the proper <br />location.
