<br />TO: City Administrator <br /> <br />FROM: Building Official <br /> <br />RE: <br /> <br />Harold Phelps' Request for a Variance <br /> <br />DATE: March 15, 1983 <br /> <br />As per our conversation in regards to the above referenced variance, I <br />have briefly reviewed the City maps for similar such developments and <br />found, as noted on the findings, that others have been approved as well <br />as denied. <br /> <br />These would include but the following: <br /> <br />1) A 40 acre tract in Section 4 with a 66 foot parcel to l8lst <br />Avenue NW that serves as access to l8lst Avenue NW. This was <br />approved in 1981. <br /> <br />2) The plat of Caroline Acres in Section 4 which creates a more <br />serious situation than the Phelps'request. I don't know when <br />this was approved. <br /> <br />3) Mr. Tom Holker requested authorization to subdivide a 20 acre <br />parcel in Section 3 that was denied because he also wanted to <br />develop other properties behind this 20 acre parcel. <br /> <br />There are other areas of the City, with City streets, that pose the <br />potential for much greater problems than this proposal of one dwelling <br />on a 30 acre parcel. Further, the owner has agreed to the placement of <br />a restrictive covenance in his deed which would prohibit any further <br />subdivisions until a City street was installed. <br /> <br />In view of this, I feel that this variance should be granted contingent <br />upon the restrictive covenance. <br /> <br />~~li&-uJ <br /> <br />CRB:p:fc I <br />
