<br />CONDITIONAL USE PERMIT AGREEMENT <br />BETWEEN GROUP W CABLE AND THE CITY OF RAMSEY <br /> <br />THIS AGREEMENT is entered into this 10 cLday of March, 1983, between the <br />City of Ramsey, hereinafter referred~as "City", and Group W Cable of Quad <br />Cities, Inc., hereinafter referred to as "Permittee", to install and operate <br />a 110 foot microwave tower and an appurtenant structure at approximately <br />16501 Nowthen Blvd. N.W. (County State Aid Highway #5), which property is <br />legally described as: <br /> <br />The Southeast Quarter (SE~) of the Southeast Quarter (SE~) <br />of the Southwest (SW~) of Section 10, Township 32, Range 25, <br />Anoka County, Minnesota. <br /> <br />This Conditional Use Permit is granted conditioned and contingent upon the <br />Permittee complying with the following: <br /> <br />1) That the Permittee shall allow no on-street parking. <br /> <br />2) That the Permittee shall locate the structures and drives <br />and develop the site as shown on the site plan which is incor- <br />porated as a part of this Agreement as Exhibit "A". <br /> <br />3) That the Permittee shall keep the tower and appurtenant <br />structures in good repair at all times. <br /> <br />~) That the Permittee shall construct the buildings of materials <br />which are compatible to other structures located in the neighbor- <br />hood. <br /> <br />5) That the Permittee understands and agrees that building per- <br />mits shall be acquired for all construction. <br /> <br />6) That the tower will have no additional receiving dishes placed <br />on it, other than those shown in the site plan attached as Exhibit <br />"A". <br /> <br />7) That no flashing lights be placed on the tower except those <br />required by the FAA. <br /> <br />8) That the entire site be enclosed by an eight (8) foot high <br />fence. <br /> <br />9) That the maximum height of the tower shall be 110 feet. <br /> <br />10) That on the West side of Highway #5 and adjacent to the <br />property landscape screening shall be placed at eight (8) foot <br />intervals. The landscaping shall consist of trees or other <br />appropriate plantings as approved by the City Council. <br /> <br />11) That when the tower is no longer needed or used, it shall <br />be removed within 90 days as approved by the City Council. <br />
