Mr. Goodrich stated that in February, 1984 the Supreme blurt found <br />that under the Federal Fair Labor Standards, it is illegal for <br />cities to give oomp time. If a city has employees working over 40 <br />hours, the city must pay that employee time and a half; employees <br />can no longer have amp time and overtime pay must be paid for any- <br />thing over 40 hours. 7he Oounty is strongly encouraging that all <br />employees use up retroactive camp time as soon as possible. Mr. <br />Goodrich recommended that the City implement this policy effective <br />with the next pay period. <br />Motion by Councilmember Reimann and seconded by Mayor Heitman to <br />recognize the Supreme Court's interpretation of the Federal Fair <br />Labor Standards Act and to initiate immediately the incorporation <br />of the Federal Fair Labor Standards Act into City Ordinance; <br />further, to direct the Personnel (bmmittee to review what <br />appropriate personnel policy changes may be necessary with a <br />preliminary recommendation to be made at the August 27 Council <br />meeting and a final recommendation to be made at the September <br />Council meeting. <br />Further Discussion: Councilmenber Reimann stated that this 40 hour <br />policy should apply to all City employees and all retroactive comp <br />time should be used up within one year's time. <br />Motion carried. Voting Yes: Mayor Heitman, (buncilmembers Cox, <br />Sorteberg, Schlueter and Reiman. Voting No: None. <br />F . <br />Mr. Schnelle cautioned Council against arbitrarily granting <br />variances to City ordinances without going through proper <br />procedures, i.e., findings of fact, etc. <br />G. Staffing - <br />Mr. Schnelle stated that this item has been temporarily tabled. <br />' H. Setting Special To Meet With AFSCME Council <br /># 4] R gardi"g Labor Contract - <br />Cbuncilmeober Reiman stated that the Personnel OmTnittee is <br />' recommending that the proper procedure would be for Staff to meet <br />with AFSCME and report back to Council. <br />' Cbuncilmeaber Cox suggested that it would be appropriate for a <br />member of the Personnel Oommittee to sit in on this meeting with <br />AFSCME. <br />' (buncilmember Reiman stated that the meetings are open. <br />August 13, 1985 <br />Page 10 of 22 <br />
