<br />. CITY OF RAMSEY AND TOWN OF BURNS <br />ANOKA COUNTY, MINNESOTA <br /> <br />. <br /> <br />CONTRACT FOR FIRE PROTECTION SERVICES <br /> <br />This agreement (this "Agreement") is entered into this day of August, 2006 and is by <br />and between the City of Ramsey, a municipal corporation of the County of Anoka and State of <br />Minnesota ("RAMSEY"), and the Town of Burns, a Minnesota unit of government of the <br />County of Anoka and the State of Minnesota, ("BURNS"). <br /> <br />RECITALS <br /> <br />1. BURNS desires the services of the Fire Department of RAMSEY in case of fires <br />occurring in BURNS; and <br /> <br />2. RAMSEY maintains a fire department (the "Fire Department") which personnel <br />and equipment are available, subject only to the limitations herein expressed, for fighting fires in <br />BURNS and elsewhere. <br /> <br />AGREEMENT <br /> <br />IT IS THEREFORE AGREED BY AND BETWEEN THEP ARTIES AS FOLLOWS: <br /> <br />1. Services Provided. RAMSEY through its Fire Department will answer emergency calls <br />to furnish fire protection, fire' suppression, emergency rescue, extrication, and other <br />routine services normally and customarily performed by a fire department within the <br />corporate limits of BURNS. This Agreement is subject to the limitations and conditions <br />set forth in this Agreement. <br /> <br />. <br /> <br />2. Response Limitations. Structure related emergency response will consist of at least one <br />(1) pumping engine and equipment capable of providing at least 2000 gallons of water <br />per minute and such firefighters as may be designated by the Fire Chiefof the Ramsey <br />Fire Department; or his/her deputy, (the "Fire Chief') unless in the judgment of the Fire <br />Chief, such fire can be fought with other equipment maintained by RAMSEY as part of <br />the Fire Department, subject to the limitations set forth below: <br /> <br />a. If road and weather conditions at the, time of the call to respond to a fire in <br />BURNS are such that in the opinion of the Fire Chief the fire run cannot be made <br />with reasonable safety to the Fire Department the call will not be responded to. <br /> <br />b. In the event the Fire Department is committed to a pre-existing fire emergency at <br />the time of a fire call for an emergency in BURNS such that the Fire chief <br />determines the Fire Department is inadequate to answer the fire c~lI in BURNS;'. <br />no obligation arises under this Agreement to respond to ,such call. A "pre-existing <br />fire emergency" for the purposes of this Agreement shall be a fire to which the . <br />Fire Department is called prior to receiving the call from BURNS and which fire, <br /> <br />-378- <br />
