In the event a fire call in BURNS is answered by RAMSEY, but before the fire in qlli?stion is extinguished and the Fire Department is needed to fight a fire jn RAMSEY or protect property in RAMSEY from a fire, the Fire Chief may recall the Fire Department. d. The decision of the Fire Chief with reference to responding to or recalling the fire Department to or from any fire in BURNS shall be final and no person or party shall have recourse against RAMSEY for any damages or losses resulting from such action or decision. 3. Term of Agreement. This contract shall be Automatically renewed each year following the date of this. Agreement ona calendar year basis, unless otherwise modified in writing by.the parties, or terminated in writing by either party. Each year, thirty days prior to renewal of this Agreement, the parties will determine in writing the compensation details for the next year of service under this Agreement. The first term of this Agreement is August 1, 2006 to December 31, 2007. Thereafter, commencing on January 1, 2008, each term shall be on a calendar year basis. . 4. Payment for Services. That BURNS shall pay to RAMSEY each year this Agreement is in force and effect an annual payment of $11,000. For the period August 1, 2006 through December 31,2006, Burns shall pay $916.66 per month or $4,583.33 (5 months x $916.66 per month). The annual $11,000 per year payment shall be due January 1, 2007 and each January 1 st thereafter until the termination of this Agreement. In addition to the annual payment, BURNS agrees to pay the following as compensation for services provided (service times begin at time of dispatch and end when RAMSEY clears its station following return to the station and cleanup and restoration of gear and equipment): a. $150 (One hundred and fifty dollars) for the first Y2 hour service b. $300 (Three hundred dollars) per each additional hour or fraGtion of an hour. c. All canceled calls, whenever equipment or personnel leave the fire station, will be billed to BURNS on a basis of actual cost to RAMSEY not to exceed $300. (Three hundred dollars.) d. If in the judgment of the Chief or his/her Deputy additional equipment or fire personnel from fire departments outside RAMSEY are needed to properly control or fight a fire or to perform other necessary emergency service, BURNS agrees to. pay the reasonable cost of such additional assistance as deemed necessary. . 2 -379-
