<br />Councilmember Elvig stated he was the driving force on the moratorium but if that action had <br />not been taken, the developer could have requested a postponement. Part of his action was an <br />emergency response and he could not get information from the City Attorney any earlier because <br />he was out of town. Councilmember Elvig stated he did not want to "pull the wool over <br />anyone's eyes" but the developer understood where the loopholes were and given an opportunity, <br />may have taken them. <br /> <br />City Administrator Norman stated that there is another difference, because the Planning <br />Commission recommended denial of Shade Tree but recommended approval of the two that will <br />be in front of the Council on Tuesday. He stated that with the permanent open space, if the <br />Council changes the ordinance language and there is some open space that is held for purchase, it <br />will not be included in the two projects being considered on Tuesday night. <br /> <br />Councilmember Cook stated with the property across from him the open space is not an issue. <br />The issue is then who will manage the septic and water. <br /> <br />Community Development Director Trudgeon noted that soils information is still needed for that <br />site. <br /> <br />Councilmember Elvig stated the Council does not even know if the engineering will work for <br />this site but some are bitter about the moratorium, which is needed to allow time to work out <br />these issues. <br /> <br />Councilmember Cook stated he is not bitter about the moratorium but does not think it needs to <br />be for a year. <br /> <br />Councilmember Olson stated she also agrees that the Council can move faster and the <br />moratorium is not needed for a year, even if they don't build during the winter months. <br /> <br />Councilmember Cook expressed concern about the implementation and length of the proposed <br />moratorium. He noted that the cluster ordinance is a volatile issue and that it causes a great deal <br />of public debate; however, he believes the language should be developed in an orderly fashion. <br /> <br />Councilmember Olson agreed you cannot base what you do on whether or not you will get <br />elected. <br /> <br />Councilmember Elvig stated he has not announced whether or not he will rerun. He stated his <br />main support is from large-lot residents and those are the people who are calling him. He stated <br />the moratorium has killed that support for him and this is not a political issue. <br /> <br />Councilmember Strommen concurred that it is not a political issue; it is an issue of what is right. <br /> <br />City Administrator Norman stated if the Council wants to discuss a different time table and <br />consider a shorter term, at least give an option so it can be extended in case the work does not get <br />done. <br /> <br />City Council Work Session / April 4, 2006 <br />Page 10 of 19 <br />
