Councilmember Pearson concurred with the comments by Councilmember Cook that it looks
like the Council does not know what they are doing and are placing too many moratoriums.

Mayor Gamec stated that this ordinance can be placed on every Work Session agenda.

Councilmember Cook stated that there will be the same problems a year from now as there are
today. He noted that people are complaining about one-quarter acre lots next to acreage lots and
that will not go away.

Councilmember Elvig noted that getting the ordinance done in 90 days did not make that
problem go away but it did create loopholes that the developers quickly jumped through. He
stated the process includes Council review, soil borings, and engineering review and it will not
open the floodgates like it does in the southern area where development is less expensive. He
stated he does not think there will be a wild rush of people because it will be an expensive
proposition to put this type of system in the ground.

Councilmember Cook stated this moratorium came out on a Tuesday night with no warning. He
stated he wants to talk about it tonight because he wants clear information so people can make a
logical decision at the next Council meeting.

Mayor Gamec stated he is now getting complaints from developers and landowners that the City
"pulled a quick one" on them. He reiterated this topic can be put on all Work Session agendas so
it is consistently worked on.

Councilmember Cook stated the vote on Tuesday night will not be a "slam dunk" and while he
voted to support it the last time, he may not support to ratify it.

City Administrator Norman noted that Shade Tree was denied and if they reapply it may fall
under the moratorium. With Rum River Prairie and Kelly Acres, they would not fall under the
proposed moratorium.

Community Development Director Trudgeon advised that the 120 day time period for Kelly
Acres expires on May 5, 2006, so a determination is needed by the Council by the end of April
or it is automatically approved.

Councilmember Elvig stated the moratorium was an emergency action taken. He noted that
developers will not build during winter months or sink in cluster sanitary tanks so unless it is
done by October, it will not be done until next year. Instead of six months, he stated the
moratorium might as well go to one year.

Mayor Gamec stated this is a big issue and he is getting a lot of heat about the moratorium. He
stated the moratorium issue should have been in the Council update or the Council informed
ahead of time. He stated the Council cannot be handed items the night of the meeting and be
expected to take action. In the future, the Council needs to get it ahead of time.

City Council Work Session / April 4, 2006
Page 9 of 19
