Mr. Morton stated their rate design is based on costs and capital replacement.

Community Development Director Trudgeon presented staff's summary of the notes from the
February 21, 2006, Council Work Session. He asked if the Council would like to make any
changes to this summary.

Mayor Gamec agreed that professional management needs to be included. He stated that the key
is to have a management company involved and the other question is whether the City can own
the land and have the management company involved without liability issues. He stated that he
thinks the management company will want to own the land. Mayor Gamec asked staff to raise
that question with the management company.

Councilmember Elvig asked staffto include a connection policy.

Community Development Director Trudgeon stated the second reading of the moratorium
ordinance will be on the Council's agenda and asked what happens if a project wants services
run in to their property. He stated staff would like to write in an exception saying the
moratorium does not apply if a piece of land receives a Comprehensive Plan amendment by the
City Council and Metropolitan Council to have services brought in.

Councilmember Cook asked staff to obtain a legal opinion on whether this type of exception
would require re-notification.

Community Development Director Trudgeon stated staff IS sorting through the pending
developments to see if the moratorium would effect them.

Councilmember Elvig stated there are two projects that have received preliminary plat approvals.

Councilmember Cook asked if the City needs a one year moratorium or if a shorter time period
would be long enough to get the ordinance finished.

Councilmember Strommen pointed out that the moratorium can be taken off when the ordinance
is finished.

Mayor Gamec stated if the moratorium is set, it will be for one year. Then the Council will need
to get their work done.

Councilmember Cook stated he does not know whether he would support adopting a full year
moratorium. He stated he thinks the City has been unfair to developers because they have been
pushed off several times while the Council has been working on the ordinance. He stated if the
moratorium is for one year, he thinks the Council will push off the work and stretch it out to one
year.

Councilmember Elvig noted that the City had it set at 90 days and did not get even close to
finishing the ordinance.

City Council Work Session / April 4, 2006
Page 8 of 19
